A smart entity will try to eliminate payment of damages by a passage of time, eroding the plaintiffs ability to prove "damages".</p><p><br /></p><p>A court will often adjudicate "damages" for plaintiffs which are generally never realized.</p><p><br /></p><p>I've personally experienced this phenomena on numerous occasions, having had my assets stolen by firms which survived by stall tactics, where the ability to prove damages has been eroded. One example of this is I was a member of a class action in 2002, against Paypal where my assets/account were frozen/stolen? by the defendant. An "out of court" relatively token payment to the Plaintiff attorneys, without payment to those "damaged", basically diminished/suspended future efforts for retribution. I believe most know the success of Paypal.
