Literally by definition, this spot would disqualify the coin from earning a star. So I say hard NO. But as Doug likes to say, the TPG often don't even follow their own self-imposed criteria. I wont even go into the Reverse side...
I didn't guess on this one because the coin is so... challenging. It certainly is intense, but unlovely at the same time. No star, weird, untrustworthy toning.

@ddddd - I recently received an incredible 58' mint set with some real candidates for stars. They may be my first NGC submission. How would you like to do a pre-submission star or no star, as I would really value your opinions? Or should I go with a new thread?

Honestly, I never check the new acquisitions thread. If it's good enough to post and brag about, it deserves its own thread. That's my own opinion, of course.
I'd say that's right on I'm thinking of having just the halves, quarters and dimes slabbed, but that's still 12 submissions, and one of the gorgeous franklins has a pretty nasty staple scratch on the bell. It wouldn't be so much bragging as a "What would you do?" thread. My main sentiment about these coins is great luck and wonder! I can brag or cry after grading I suppose Edit: check out bottom page 1274 on the new acq thread.
I agree with @physics-fan3.14 for starting a new thread. It sounds like you have some interesting coins. The one with the staple scratch really depends on how severe it is. I’ve seen some scratches deemed market acceptable (sometimes with a net grade). If the toning is really nice, it could make it. Please tag me in the new thread.
Will do. The one with the scratch I believe is one of the nicest Blue ones, bottom right on the 58 P page, incredibly toned on both sides with amazing surfaces. But I have to take pictures of the reverse of the coins, then I'll remember better. The pics on the new acquisition page blow up pretty big, so you can see exactly what I saw when buying them.
Unanimous opinions for no star and for AT. So what happened here? I posted this for a few reasons. This is one of those coins that I believe no way was given the star by Marks blessing. It also raises the questions if he is a finalizer for all stars. This one graded 67+*. I think it is closer to AT details or even environmental damage. To say this grades clean as a 67 blows my mind. To say it is a high end 67 is even crazier. To bless it with a star is heartbreaking. It went for $202 with 31 bids. It has 561 page views and had 35 members tracking it. Why?
I have had a set of early toned Kennedys, 40% that are what I would call Monsters, They are raw and all have toned alike. For a wild card round and just for fun. Here is the 65, it may or may not ever get slabbed. Would you say star or no star ? The marks on Kennedys face are what I would call bag marks, and should lower the grade. Todays market grading I would call this one a 62 at best.
My understanding is that Mark spends very little time in the grading room these days. He is an astute grader, has a fantastic eye, and is extremely knowledgeable. However, the vast majority of coins that go through NGC are never seen by him. He'll look at the really special ones (anytime an 1804 dollar goes through there, you can bet he'll look at it), but something generic like the Kennedy posted has no chance of rising to his level. He's too busy making bad business decisions and alienating his fan base.
