    Actually in a case of controversy this long in the tooth, it does precisely do so. Were this an issue that came along freshly rather recently, EAC would be correct. Under these circumstances, he's nuts. Every day that passes without court intervention, Dan is in less and less legal jeopardy.

    Some of the biggest advocates of illegality have already been discredited by complaints that were rejected and some even by the courts themselves

    I simply do not understand the emotionalism of Dan's opponents. What is it to them? Why do THEY care? [By the way, these are the questions the judge would ask at the prelim hearing stage.] Any private complaint against Dan would be wiped out on the first response to pleadings.

    Roughly when was Dan's first overdate fantasy piece? It goes back AT LEAST to my first ANA show. I still kick myself for not picking up a Buffnick from him.

    And it’s not my brain that goes mushy. The problem with these threads is that few are willing to embrace logical consistency. Remove emotion from the discussion and things become much more clear even if not definitive.

    Something that is not useful when a unique fact pattern is implicated. NO ONE ELSE ANYWHERE is doing precisely what Dan is doing. EVERYONE ELSE is doing something a bit differently in ways that matter greatly.

    Anything that might have been dismissed on the pleadings won't even have a citation. I don't know of one in particular; I'm jus' sayin'.

    To be researchable, it needs to have more than just a Complaint, and would need to be a published Opinion.

    I was done with the argument. The other poster alluded to some court case. If there is one (there's not), then it is time to put it out there so we can all follow along. After all, if there is a court adjudication, it moots threads like these doesn't it?

    Oh Gawd, not that legal Einstein "Roger Rabbit"! He's an embarrassment! A Pennsylvania trial jury found our member RWB to be "not a credible witness". Granted, that seldom deters "testifiers for hire" like him.
