Canada absolutely passed NEW regulations - much more stringent than American laws. I am sure I am going to get corrected by someone, but it is my understanding that it is both illegal to sell and to possess any copy/replica. PERIOD.
If you realy do want to stop the fakes then you will have to ban totaly the import of all coins into the USA and that includes handing over any coinage that you might have at airports or sea ports, land crossings from trips abroad. If you dont do this then there is no way of stopping it. You can legislate all you want you can rant at ebay all you want but until you can close down the factory in china or wereever it will continue. Then you have the question should it be legal to sell a genuine ancient fake :smile Oh they are out there guy's or a fake from the 18th century or even 19th? Exactly what law are you talking about enforcing and against whom? Counterfeiting? The people making themcare in China and outside your jurisdiction. And what they are doing is legal under Chinese law. That just leaves Paypal, ebay, and the buyer here in the US. Ebay and paypal have done nothing wrong. Ebay listed an auction from someone in China listing a legal product. A replica coin and marked replica Paypal was used to pay for a legal product. What grounds do you have against them? You might ask "Well what about the auctions listed where the seller is selling an unmarked copy as the real thing?" OK, how does eBay know it's a fake? They aren't coin experts. They don't know an auction list a fake until someone tells them. Then they have the problem of determining if it is fake or not. You wouldn't want them pulling an auction anytime someone just says so. And they don't have the coin in hand to examine so unless the person complaining can explain exactly why it is a fake and give some proof, they will probably let the auction run. (To give them their due they have been much more responsive lately about pulling questionable auctions than they used to be.) So this leaves the US citizen who buys a marked replica and receives an unmarked one. OK he HAS committed a violation of the HPA by importing an unmarked copy. Does the government track all the eBay auctions for the marked copies, get the buyers info from eBay, track them all down to see if they received a marked or unmarked copy in the mail and then arrest the people who receive unmaked copies? As I said, they haven't really done anything wrong. That is correct, but it is not new legislation.

All very reasonable. Conder is right - E-Bay doesn't have much coin expertise, nor would I expect them to. Yes, we can't have them pull auctions willy-nilly every time someone complains... but we have had good results when many complain about a truly bad auction. They frequently pull them.
Typically everybody blames ebay as being how most of these coins get into the public's hands. But what about all the coin dealers that sell them in their shops and at shows ? I suspect that there are as many, and maybe even more fakes sold via dealers than there is on ebay. Matt I'll give you this much regarding new legislation. As it is now, it is only illegal to make or import fake coins in the present time, or since Nov. 1973. But there is no law, at least none that I know of, that makes fakes made prior to that date illegal to own. So - that leaves a gaping loophole. For how do we prove when a coin was made ? And passing a new law that makes it illegal to own any countrfeits is going to run smack into huge roadblock from the collecting community itself. Just as De Orc recommends making it illegal to import any coins - the collecting community is fighting tooth and nail, as we speak, against laws that make it illegal to importcoins from just 3 countries ! Can you imagine the outcry if it was all countries ?
I really like the comment about making the copy or replica marking integral of the dies and making anything else Illegal. Don't give them the opportunity to not stamp the coin. I believe that would be the simplest solution. This is a really good discussion. I feel really strongly about this topic personally. It's not only effecting my buisness but it's also effecting the hobby I love. I just can't accept that there isn't anything we are able to do.
There's a dozen things that could be done Matt - but nobody has the money to pay for it. Therefore they won't. Like it or not, if it is not in the budget - it aint gonna happen.
