I believe respectful posting caution/discretion is prudent in a thread where we've seen a single-sided OP claim, and seemingly considerable conjecture. There appear to be discrepancies and possibly incomplete disclosure, which may create posts adjudged to be libelous or defamatory with adverse consequences. I realize that individuals posting negative statements believe in impunity, but if numerous unsupported inaccuracies are stated, the consequences may warrant action by the offended. JMHO
Look out CoinTalk, your going to get sued .. Lol............................................................................... Good luck on that suit ...........................
Not that it matters. There is substantial legal precedent limiting the liability of an online forum for words posted by members. Worst-case scenario is someone with the legal right to ask requests the words go away, and the forum Admin makes the words go away. No harm, no foul. As regards individual poster liability, well, there's more than one way to learn how to be circumspect and some people need to learn the hard way.
There's no liability to any members of cointalk, for getting sued . This is a open forum, that a member has asked a question and there will be responses from other members . Cointalk will do the rest about breaking their rules ...
I believe the site can't be held responsible unless culpability is shown, which the stated rules for posting should show disallowing. http://www.writing.upenn.edu/~afilreis/defamation-in-cyberspace.html If you'd like, I believe precedents can be shown for open forums. JMHO
[sigh] What a waste of energy (getting lawyers involved), but folks do it..........everybody go back and do a quick edit of all of their posts. What's that you say? You can't do the edit thingie? You may be had........
I can says this, if someone thinks there's a law suit, go ahead and try to sue . You won't get to first base and there will be a counter-claim filed, in a New York Second too. I know some lawyers that will spend your money, faster then you could make it and sleep at night too, knowing the case will be dismissed ...
I'm sure this thread will be closed down for Political violations .... Now that's against the rules ......
You can be sued for anything and it will cost you money to defend it. You may win but it's a gamble if the court will award you back your legal cost. The lawyers are the only ones that win.
I'm certain that several in this forum remember Mr. Alan Hager of Accugrade, the seemingly negative subjective statements by many, which eventually may have precipitated the demise of his firm, and the action that ultimately ensued. I believe that if malicious aforethought can be shown by in a herd mentality, many may ultimately be involved in adverse justified? litigation. A retrospective footnote is that ACG coins have been recently submitted to top tier TPG, resulting in ACG assigned identical or advanced grades. Times are a changing, but possibly not actions. I read some of your link and noticed a new member "elevencents" had a lot to say defending Accugrade. I'm guessin that's "Redwin" here, who used to constantly post about his penny over dime overstruck coin that he allegedly declined an offer of 7 million dollars for. SMH
