    Cat,

His comments can't be libelous if they are presented as opinions. IIRC, he started one of the posts in this thread with:

Having said that, I don't agree with NotSure's opinion of Mark Feld even though I do not read the PCGS forum. My opinion of Mark is based on his actions on both this and the NGC forum (which he is still very active).

Well, OK, perhaps then the inference "borders on being libel". I ain't a lawyer, but the point still remains! :D

For libel, please tell me how Mark's reputation is damaged? Next what damage has he suffered?

    Opinions certainly can be libel.

Where in my post do I claim, or even infer, that he is a moderator? I simply state the newly reinstated 'polices' the area.

For the record, I have not said ONE bad, or malicious word toward Mark Feld the man OR the dealer. His reputation is glaringly professional, and he is obviously one of the better, more knowledgable and trusted dealers in the hobby. So, for those that are saying I am being libelous (which is utter BS), there ya go.

    This is true.

THE question I have is where in ANY of my posts did I say this 'New Sheriff' is, indeed, Mark Feld? Catbert, you are the legal eagle, apparently, so I direct this to you....how am I being libelous to Mark Feld? You can ASSUME anything you wish, but please provide proof that he is being libeled.

Only if presented as facts. If the written comments are clearly presented as an opinion, they can't be libelous. That does not mean that an over zealous lawyer couldn't sue for libel anyway if even a comment is presented as an opinion.

Notsure - This is what I inferred from your posts:

    1) Former banned PCGS board members are now reinstated
    2) At least one of these members now is policing the board (I infer you mean Mark Feld)
3.) PCGS board members are being banned due to the police reporting their activity.

I am not a lawyer and so I will retract my allegation. However, I don't think I'm crazy to draw an inference from what you are so careful not to say. If you wish to say you are not directing these comments toward Mark, then say it.

Absolutely wrong. I'm a lawyer so let me set you straight. If I were to write "it's my opinion dealer X is a child molesting, cheating, wife beating, ex con" . If any of it were untrue, dealer X would prevail in a lawsuit. Just saying "it's my opinion does not protect you". Period.

Catbert, I appreciate your withdrawl. However, I value my posting priveleges here, CU, NGC, to name the major forums I am on. However, I will never come out and state the persons name, as yes, I do believe what is said on another forum can and will be used. My stated views on Mark Feld have been nothing less than complimentary on a numismatic level, if I am not mistaken.

You are very correct in that I am very careful in choosing my words.

I don't care if it was libelous or not.
Your post was an insult to many here and to Mark.
You should think a bit more about what you post.

I thought very carefully about what I posted. You just seem disturbed it MIGHT be about someone you THINK it is. Wonder why that is? Could YOU be the one inferring he is doing this? I have COMMENDED Mark Feld as a knowledgabe, honest, informative dealer, and quite honestly, if I were to get his opinion on a coin, and unless Q. David Bowers contradicts Mark's statement, I can pretty much take it as gospel.

Perhaps I should change my username to Woodward/Bernstein.

I can read between the lines. In any event, I've said what I wanted to say and will not continue pressing my views.

Of course you can't make a false allegation and simply call it an opinion. An easy way to settle this would be if you could provide us to a link to a case where someone was successfully sued for libel for presenting an opinion.

Contradict yourself much??? You would be an easy target on the witness stand.

I will gladly provide a link if an obvious non lawyer such as yourself wishes to retain me. PM for my hourly rate. I can tell you probably can't afford it. EDITED
