Kicked off the eBay boards AGAIN (this time, 30 days) c/o SGS "graded" coins!!

    The trademark protects the use of the name, emblem, colors, etc, within a specified industry or group of industries.

    new coin grader

    After seeing how succesfull sgs is I decided to start my own grading company. My ebay ad will go something like this. Up for bids is this BSGS graded ms70 Lincoln cent. This coin has been graded a perfect ms70 (perfectly trashed). It is a 19?? Lincoln memorial cent (we think). You can buy with confidence when you bid on this coin that has been graded and authenticated by BSGS (bull s*** grading company).

    next

    This next coin is at the other end of the spectrum. This coin has been graded by BSGS as a g4. It is a rare 2006 Lincoln cent, but has an undetectable flaw thatwould surely kill any value. Now I just need some coinworld slabbs. I'll have to work on the pics as they are a little to clear.:D

    Whatever bad things the owners of the coin-related SGS may be doing, trademark infringement is definitely not one of them, unless the federal trademark laws have drastically changed in the two years or so since my last involvement in trademark litigation. There is absolutely no trademark issue about using the initials of a slicing machine manufacturer for a pretend coin grading company.

    Fundamental elements of trademark infringement are competition by both parties in the same industry, a possibility of public confusion between the companies, and a likelihood that potential customers may be confused about the source of the goods.

    That's why Toyota can market its Lexus car line, and Lexis-Nexis can market its internet database access, without either one infringing the other's trademark. (It cost Lexis-Nexis a bundle in court costs and attorney fees to find that out a number of years ago. ;) )

    I think the pics would be a little better at clarity if you spread a slight dab of vaseline over them.

    Is there a reserve on your first cent? I loved it lol

    Since these coins share the same picture with your other item number 8421590211 and an item being sold by Mentone_mercantile as item number 8423257493 , a place over 2000 miles away, how do I know what coins I will recieve if I bid on these.

    Hi All,
    The plot thickens. I just connected another dot! Check out dew1111 EBAY item number 8425318603 although it is reduced a little , it is the same picture as aboncom EBAY item # 8423306833 scroll down lower on the page to see the picture it is not the same as the picture aboncom has at the top of the page.

    You can tell by the reverse of the coin. It is rotated in the slab and the word UNUM is blurred.

    They are the same picture. Who really has the coin for sale? Who knows!

    I think the only legal chink in the armor of this contention is that Ebay tends to allow stock photography, wrong or right, and these coins aren't specifically identified as being the actual coin pictured. This is a fairly small offense in the grand scheme of things, and might tend to obfuscate the major issues if pushed too hard.

    I hope you didn't mind me giving that thread a little publicity. With the understanding that, even knowing now what your nick is here, I still have no clue as to your actual identity, nor am I acting out of any interest save the altruistic desire to right a wrong. This isn't the only place I've left that link.

    Those are your words that came from your website written in bold print. Now, I personally find many problems with that statement.
    • SGS is not a grading company! PCGS is a grading company-you're running a gigantic scam production
    • You have no standards-let alone quality and integrity
    • Graders working at PCGS look at every coin with the possibilty that its grade can range anywhere from 1-70...you look at the same coin and think its grade can be 69-70
    If Midas can get kicked of eBay boards for voicing his opinion-then I think it'll be pretty easy in the near future to get SGS shut down for good for the crap your dishing out.

    OK Ok Here is the perfect example of an ebay seller using a photo of a coin the he isn't actually sending to the buyer without stating that it is a stock photo.

    I won a 2004 silver Kennedy proof coin for 2.02 plus shipping. It shows up today with it's 63 cent stamp and it has some kind of stains over the face and over the eagle on back. It almost looks like rust or coffee stains but is nowhere near what you'd call toning. Here is his description:

    This Auction starts at .01 cent no reserve. You are bidding on one 2004 S Proof Kennedy Silver Half Dollar. This coin has looks like a Deep Cameo.This coin is .90 % silver and will arrive in an Airtite Holder. Must be satisfied or simply return within seven days for a refund. Prefer Paypal, cashiers check, money order or personal check. Good Luck Bidding!

    Where in this description do you see "stained like hell"? I think because I got it so cheaply, he decided to switch coins and sell the real one again. He probably figures that if I return it, no big deal, and if I don't he gets rid of a worthless coin and gets to sell the original coin again. I've emailed him and ask him to return all of my money and then I will mail his coin back. If he doesn't I'll keep it and complain to ebay and leave bad feedback. He currently has a 100% rating. That'll change.

    Any other suggestions?

    I'm also jackeen over on eBay. Well, over there I'm jackeen666 (it's a long story).

    I was also suspended over there for my entanglements with Steve and SGS. Only for seven days, though.

    The thing that strikes me most about this whole affair is how Steve has repeatedly made things worse for himself and Abombcon. Had he not swaggered onto the eBay coin board, there would not be such spillover here and elsewhere.

    Now he's irritated people with connections to the ANA and "real" coin publications. People even less likely to be cowed by his lawsuit threats and his ignorant ranting about anti-trust laws.

    An accountant friend of mine once observed that "pigs get fat, and hogs get slaughtered". That was his homespun way of saying that fraudsters who call too much attention to themselves run afowl of the authorities, while less flamboyant practioners of the same "art" get away with their misdeeds.

    Here's hoping the SGS hog is edging ever closer to the butcher's knife.

  18. The thing about joe-blow (a.k.a. jackeen) is that he/she/it has repeatedly resorted to name calling, throws out red herrings to try to confuse the issue, and has no scruples regarding mistatement of fact.

    Go figure, he is dead set on killing SGS, and has no scruples regarding lies and gross exaggerations, he will lie, cheat, and mislead you to do it.

    His line "defending SGS" is a misleading thing -- especially when he was attacking my name, and it was my name to which I was defending.

    Jackeen -- you will definitely pay a severe price for the lies and falsehoods, derogatory, defammatory statements he has made. Your reward Jackeen, will be quite severe, and it wont be by my hands, but your own words -- per Proverbs 19:9 - "a false witness shall not go unpunished." As Jesus said, he who has not sinned, let him cast the first stone. Jackeen -- you are not without guilt. Take the log out of your own eye before you attempt to take the splinter out of mine.

    Setting aside all issues for this note.

    It was a while back that I suspected that Jackeen and Zack (midas) were one and the same. Their user ID's were established only a few days apart on Ebay.

    What is unfortunate is the news that he and his wife are apprently divorced (or possibly splitting up).

    I wish that experience upon no one. And, so Zack (midas) if that is the case, I offer that I am sorry that you had such a bad experience, for I too had a really bad divorce that involved three years of tough times and a pile of legal fees. The worst part -- the other side made all sorts of false and misleading accusations, which too, were quite costly. I wish that upon no one, no you, not anyone.
