I need help for a friend who got scam by a coin shop

    Again, an individual who has access to $8,000 and the capability of getting to the coin shop and her friends home, who lives a 100 miles away, shows me that she has no "diminished capacity" nor mental infirmaties which are commonly associated with the "elderly".

    In this particular case, I think she made a poor decision based upon whatever the coin dealer told her and whatever she read or heard either on the internet or some doomsday TV show.

    If the dollar collapsed tomorrow, who would be the scammer? Could the dealer repurchase the coins he sold? A transaction is a binding contract between a buyer and seller. Dealers try all the time to overcharge me for silver. I refuse and negotiate. I don't consider them scammers.

    First off, I stated that I didn't appreciate being called "chief" and asked you not to refer to me as that...there is nothing wrong with that. Those of us with Native American heritage don't appreciate such comments. I was perfectly civil. I gave you the option of referring to me by my username and if you chose not to I offered another suggestion. I did not "introduce" my patients or any "issues" to this thread. Another member mentioned my patients and I answered his statement. Plus, there were no "issues" about them discussed. You implied that I am taking advantage of my patients with the following statement:

    I then defended it and explained how I deal with patients whom I am concerned may not be capable of making decisions for themselves. But, I certainly did not "introduce" my patients into this discussion in any way.

    You don't see it bothering me much? I have said several times that what the dealer did was "reprehensible." At no point did I say it was acceptable. I said based on my understanding of the law...I don't see anything illegal about it. But, I never once stated it was acceptable or moral behavior. I felt that your comparison of this situation to someone dressing provocatively being responsible for their own rape was an incredibly immature comparison. I understood what you meant the first time I read it, but I don't agree that it is an appropriate comparison. It is no different that saying the guy wearing red in the Crips neighborhood deserves to get shot. Those are inappropriate comparisons.

    I am also not "ranting" about my business or my patients. Every time (with the exception of saying that you could alternatively refer to me as "doctor" rather than my username if you chose) I mentioned by "business" it was in direct response to someone else's statement.

    Finally, based on your own posting about Florida laws you have stated that she is not an "elder." I agree with you, she is above the age of 60 and is therefore a senior citizen. But, if you actually read this link, the very link you posted you will see that she is not a "elderly person":

    I have posted the Florida legal definition of "elderly person" twice before in this thread and someone else has posted it as well. But, I will post it again for a third time and you will undoubtedly ignore it because it doesn't fit your argument. Here again, for the third time, is the Florida legal definition posted in it's entirety from the very link you posted:

    Again, this person may be a senior citizen based upon her age alone...but nowhere has the OP stated that she is in anyway impaired as this definition requires.

    You keep stating that I have no legal knowledge...it's true I have no legal training. But, I can read. I have asked you several times what your legal expertise is and you have ignored it. I therefore assume you have none and are concealing that fact because it's easier to attack my background than state yours is as weak as mine.

    I "declared victory" because I posted a well reasoned statement about how this woman doesn't fit into the "elderly person" description based on the Florida law that you posted. I also admitted per your accusations that I am not a legal expert and I asked for your legal credentials. Your response was the following statement:

    I felt that this statement was proof that you had no other well reason material to discuss with me so you decided to sink to juvenile statements about my patients. Based on that, I figured that you had nothing left to add to the discussion. That is why I "declared victory."

    As for my moderator comments, I asked everyone to stop making insulting comments towards each other and stated that we needed to get back on topic. You seem to want to argue that with me by accusing me of "ranting." Yet, my very next post after that statement was an attempt to get the thread back on topic...which you immediately tried to derail. Now, I suggest that YOU stay on topic for the rest of this thread. If not, I will personally deal with YOU.

    I think that what the dealer did was highly immoral...as I have stated several times before in this thread.

    LOL, you are right. Lets try and get back on track here.

    I still think the dealer is the scammer. Look at it this way. The day she bought the silver, it was $28.85 per ounce. She purchased $1875 worth of silver for $8000. This means she got 65.1oz of silver. So, lets assume the dollar now collapses and it is nearly worthless. She is better off with the 65.1oz of silver. However, lets go back and say the dealer charger her a $500 premium (which still seems high) instead of the roughly $6100 premium. She then would have gotten 4x the silver and had 260.4oz. So, I say the dealer is still the scammer.

    I don't think you can use future changes in circumstance to rationalize immoral acts of the past.

    Of course I do, Marshall. My post was simply an observation that a significant percentage of the membership here seem to think exactly as bkozak said. In no way was my post intended to be in defense of the dealer in question, or any seller who does not hold themselves to both a reasonable and respectful standard. Unfortunately, while there are people such as you described above, I think we both know that the anti-dealer rhetoric on this site can, at least at times, be taken to the extreme and without valid reason or cause.

    I apologize to you if my intent was misunderstood or misconstrued.
     
  12. I fully agree we should keep this thread alive. While we wait to hear back from the OP, how about a little levity? Maybe she went into the coin shop, spotted the $1875 worth of halves in the display case and asked the dealer...how much? He looked up the spot price of silver on his cell phone and said $2000. She pondered that for a few minutes, and said that is way too low, I will give you $8000 for them. To get this you would have had to see Steve Carell on Pawn Stars last week. He actually bid Rick up on an item...very funny. BTW: I hope Big Ed's friend get some or all of her money back. :smile TC

    BigEd said a few pages back that he has been very busy and may not get to look at the receipt until Friday. So, we may have to wait a week or so before any new information is available.
