Help Me Play With This eBay Scammer

    You need to look up the definition of "defraud" and "scam". Just what regulation are you planning to use to remove this seller with your "difinate [sic] case".

    Clearly you don't know the law. Yes, this ad crosses the line, any collector knows the reference to the No P error and knows a philly cent is never listed as No p - this ad is meant to mislead a novice. eBay will also agree, as they have with other complaints I've made that this ad misrepresents the item being sold.

    There are many good people in this hobby, yet I encounter way too many that are so used to the con game played by many that it is disheartening to see their "twisted" view of reality.

    Enough is enough, if you feel so strongly that this seller should be defended, defend him to eBay, you're wasting your time here. Thanks for the general link to the book of eBay - I know the specific reference to MISREPRESENTATION.

    His wording in not complete, bairly leads one to think, and otherwise is just another eBay ad from someone indending who knows what but it is not a outright lie or deception at all.

    I really can't see this one coin sending anyone to prison. I'm thinking any judge would be upset if it even came to court. I don't even think a DA would even look at it.

    On the other side of things. The seller has 400+ items for sell. If it could be shown that this seller does this all the time, there could be a case a DA would look at.

    From the one coin I can't see how the guy broke any laws or rules.

    Well true, one $45 coin probably wouldn't send him to prison, unless the DA wants to make an example out of him. His ad definitely shows his intent to deceive and you are correct, he has over 400 ads and others I've looked at are equally deceptive. So, it would be tough for this guy to claim ignorance.

    I only buy and sell on eBay. First time I made a profit on a coin was on eBay and I've almost always been low balled when I walk into a shop. If I want to take the chance of being conned, I walk into a shop - I'd say 8 out of 10 times I walk into a shop, the con starts.

    Calm down guys. Let's not get heated. I feel it is misleading as well. But I'll play the devil's advocate here. If you tried to "convict" him of his so called intent to scam/defraud someone on this particular coin, wouldn't that be entirely subjective? I don't know the guy, nor his intent. For all we know he could be a person that is ignorant, on drugs, insane, etc. I'm not going to argue semantics, or say that he is or isn't. But we shouldn't be so closed in on the fact "O, he's trying to scam", because we don't know that. I don't see where he is legally wrong, because the evidence that has been shown the past few pages is based on his intent, and that at the moment appears to be entirely subjective, and a matter of opinion. And if you want to uphold the letter of law, you can't convict someone just on that. What happened to innocent until proven guilty?

    I again do feel it is misleading, but I don't want to go and jump the gun. Let's try to figure out the story, and instead of "playing" or "toying" with this guy, why don't we educate him instead?
