A lot of this BS goes on because a small claims suit must be file in the sellers county and Illinois can’t sue Texas – at least it is usually not practical due to the travel.

It is probably a dumb question, but is there some way, in this case, Spider could have someone else who lives in Dallas area (i.e. another CT member) file for him? My guess is that it can probably be done, BUT the methodology will vary from state to state (county to county?) and is probably at least as impractical as traveling there to file. Where is satootoko when you need him?

I have also heard of more than one instance where contacting the local police has helped. They pay him a “friendly” visit. However, my only attempt was singularly unsuccessful.

wait guys do not claim anything against him yet, I called paypal and they said I should have my money back in some time soon. I have proved his wrong and they said there is a really good chance of him failing to reman a scammer like this. I pointed out his misrepresentation and paypal said if he doesn't do anything to help the matter, like he already has, then they say no reason why not to refund my money

Unless something weird is happening between this seller and PayPal, they will not refund your money unless and until you get a confirmed delivery for the returned articles.

Tell them you sent the items back, but due to the sellers obvious dishonesty, he's claiming he never got them...even though you kept them. then tell him he didn't read your buyers instructions well enough, and that you're not responsible for lost items in the mail.

It your call, Spider, but I wouldn't give the guy the satisfaction of even getting the coins back. He'll just turn around and do the same to someone else.

I've been reimbursed by Paypal without delivery conf. before, when the seller said item had been shipped and I never recieved it. Whats the difference?

Difference = received - not received. i.e. something to return - nothing to return

I don't think the giving a 5 on shipping only if the shipping charge is exact shipping cost is not right. you need to take into consideration packaging involved. Bubble mailers, tape, and packing cost money. It's bad enough with all the ebay fees on small items, so you shouldn't have to give away packaging materials too.

Spider, I feel bad for you on this whole situation, it really sucks sometimes to work this stuff out.
    I hope everything ends well.
Me personally. when looking at a bigger sellers items, I really look over thier feedback to see what kinds of hassels other buyers have had. I don't even want to chance it.

Yikes. To you in 3 days? If you ship by the post office, it's kinda out of your control how long it takes to get to you. So if the guy ships it out the same day as you pay, and it arrives 4 days later you're going to ding him?

Before going on-- Spider, I hope this all works out.

The past few posts have been a great example of why the 5 star system, while arguably better than the straight postive/negative/neutral, is still pretty subjective.

Another example: I bought an item "now" (not coin-related) and paid immediately. In the Paypal comment I added, as I always do, "Please advise when shipped." Not a word so far, and I am assuming I will know it's shipped when it arrives in my mailbox. What do you suppose I should offer as a 1 to 5 star grade for "Communication"? Can I give out "zero"?

1 to 5 does not allow for a 0. No stars is ignored as being not filled in.

Paypal has more power then you think. I have been selling a few things on ebay, had a guy pay me via paypal, I shipped his item out the next day, Delivery confirmation with it.

A few days later I get a charge back via paypal saying he was disputing the auction. I called paypal to find out what was going on. they told me he said he checked the shipping number and it was invalid. I gave the guy at Paypal the shipping number, says the guy received the items as such and such a time.. They went back on his account a ways and found that he had done it everytime to every auction. He lost his paypal account and I got my money.
