China based seller blatantly pumping fakes onto the bay...

    Saw this on another forum, could we also pitch in and help take this seller down?
    He's identifying them as fakes and selling them as such. Has multiple listings and has already sold a dozen!!!

    Problem is, Ebay profits from the final value fee for whichever gullible buyer ultimately takes the plunge, so it really doesn't have an incentive to take the items down. I've reported fakes repeatedly, to no avail. Perhaps if they were held legally liable for all fakes on their site? That might focus some minds!

    Honest question here.....

    It is obviously illegal to print US currency.
    Is it legal to mint US coinage even if labeled 'fake'?

    I would think printing and minting is illegal. Shouldn't the Fed's be notified? Maybe if they crack down on the buyers for possession of counterfeit coinage like they do for currency then buyers might be more hesitant to foray into buying the fakes. If the outlet for the sellers dries up (the buyers) maybe they won't see the profitability any more.

    Yes, no need to report fakes anymore. They got out of the business of honesty long ago...

    It's a simple business decision for eBay to not attend to each and every one of the fraudulent sellers/buyers.

    It comes down to a cost-benefit analysis: If the level of fraud on their site reduces their revenues (fewer bids, scaring away customers, etc) by a only certain acceptable percentage, AND that cost is less than the cost of tackling the problem, then of course, eBay isn't going to bother.

    And eBay probably doesn't bother banning people with whom they don't have bad business interactions. The seller in the OP is selling fakes, right? EBay's answer to that complaint would probably be that he/she is paying the fees, shipping on time, and following the other rules and communicates respectfully to buyers.

    All I get when I click on any of the links is an error message. Maybe the seller opened an account under a different name (And IP address).

    If the coins are labeled COPY in the size and depth specified in the Hobby Protection Act then they are perfectly legal. If they are unmaked and made before 1973 they are perfectly legal.

    The problem is these unmarked fakes are made in China where US laws do not apply. They can legally make them and can legally ship them to the US. It is ILLEGAL for the buyers here to import them into the country or to resell them. So if hte manufacturer in China is listing them on ebay, it is the buyer here that is breaking the law, not the manufacturer.

    Also under the HPA aiding or facillitatingin the sale of such unmarked fakes is illegal, which means that Ebay is also in violation of the law if they are informed that they are fake and they continue to allow the sale to run. The problem becomes who is going to file charges against ebay and foot the bill for carrying out the court case against them? Would probably run into the millions.

    "gullible buyers"? "fraudulent sellers"?

    If the ad says 'fake / repro', how can the buyer be gullible? How can the seller be fraudulent?

    China owns a HUGE part of United States. WTH do you think Washington DC is going to do (besides help them to pimp fake / repro junk) ?

    I don't like it either. But IF I want to do something about it, I know better than to post about it on facebook / public forum, etc...
