I purchased a coin from an ebay auction, with direct payment through Paypal. Ebay supposedly withheld funds from the Seller, due him from past ebay sales, which would have allowed him to repay a loan on his temporarily "hocked" coins. He seemingly hadn't physical possession of my purchased coin. He figured ebay would eventually release his funds due from ebay sales to the source temporarily holding coins as collateral on a temporary loan. I've received multiple statements from other sellers stating that ebay will hold funds indefinitely, as Paypal had done to me in the past, never recovering. I'm told ebay can't be sued, as in the past they were just an intermediary. I've closed my Paypal account to determine if funds are going directly to ebay if something is purchased off of the ebay site. I've now ordered something from ebay, paying directly from a bank account. The reorder payment was sent directly by certified mail to a POBox address, payment paid to Sellers' bank account. I can file an action against the seller in small claims court through subpoena action, and report federally to Postal Investigators. JMHO
Request a thread closure, as I still have a responsibility to aggrieved victims of believed ebay damages for funds withholding.
In a court of law, general contract law dictates a "meeting of minds" before a party changes status of original agreement. When a singular party changes the contract, it is void with potential damages. Ebay automatically filed a claim/case for "buyer protection" without any communications. When the Seller didn't respond, telling them he wasn't, they did nothing! When I contacted Paypal because ebay hadn't properly responded by returning my funds, ebay closed my case, legally voiding my responsibility to continue seller-buyer communications through them. Thus a new seller-buyer contract was directly generated. It's believed Ebay had a fiduciary responsibility to promptly return my funds, which was established by the delayed refund from Paypal. JMHO
You got scammed. Twice. Drop all the pseudo-legalese garbage and wake up. Who in their right mind gives somebody money a second time, knowing full well that they do not possess the item being purchased? They're supposedly going to use your money to go buy back this coin from a pawn shop and then send it to you, instead of just pocketing your money (again)? Why on earth is this ebay's problem? This is merely a variation on the old Nigerian prince scam. Wake up. I'm done with this.
Thank You It was a challenge to complete your simplification. I now believe any court would recognize that even the simplest critic has been recognized, properly completely answered, corrected. I find it difficult when I'm leading a new challenge of explaining to others, rather than just doing things that have never been accomplished or understood. It's easier to just completely satisfy a singular "informed" judge. I trust you'll recognize there's no offense intended, just an attempt to complete the facts with a computer that has a mind to change things! JMHO
I deal with Sellers-Buyers all of the time on Craigslist, with me selling raw AU-MS coins at a condition/price appreciably better than any internet source. The buyers often believe they have something certified in which I might have a partial payment trade interest for something I've advertised. We agree to meet in the future, and it isn't uncommon for them to take more than a year for a return call that they have their trade item. These ebay changes are new, and untested, maybe eventually resulting in further changes. I included a recent finalized 8 figure sum Paypal case in my explanations. The elements for final resolution were relatively quite simple, which they knew! Just pay the Plaintiffs' Attorneys a greater portion of the agreed settlement amount. I believe ebay/paypal are currently figuratively "A Wild-West atmosphere", dealing with more very clever Sellers. Two sent a "Gotya" this morning with one getting through to plant a "trojan" which will require changes as closing current accounts/suppliers/contacts/identities. Incidently, the "Prince" called me recently on one of my phones, where I listened before wishing "A Good Day"

I'd like to believe any sharpness that I've retained is from hiring young men as helpers. I believe in hiring young intelligent slim tall strong men, as helpers. I explain my plans, listening carefully, and accepting any differing suggestions with an "open mind". I definitely appropriately compliment when they outperform me, pay them greater than their requests, and supply answers when they have a problem. They, as I, really enjoy the interaction, and shared learning experience, expressing same. My spare time is spent playing mentally challenging games as Bridge, Chess, and games of others choice, with younger people. I usually pay, thank them after a distinct period, because I enjoy adept competition, and usually win. I let them know the payment is compensation for letting me win, sharing their home, and my wine with me. Thanks for your evaluation!
Hmmm! Why doesn't it surprise me that a resident of your area might think in that manner. Well, I've had one of the most beautiful ladies you'd ever meet as my partner for >30 years, and we've NO problems! Her son who adores me, is as I've described, and we ADMIRE each others' knowledge/experiences. I teach him much about my copyrighted property for his large construction crew. He is available for maintenance work on my large 60-80' Oak/Pine/etc. trees, fourteen foot high cameras, metal roof snow removal, etc.. My young business partners are the same, and we virtually don't need to speak a word to communicate, as body movement is essential around loud equipment. To each his own! Who am I too judge! TEE-HEE!
I appreciate your usage/comprehension of English, but multiple languages is normal in many established nations other than ours. When teaching, versatility is important, even though my primary language may be unacceptable here, it's very acceptable in academia/courts. JMHO

The OP is trying to collect the funds that PayPal supposedly withheld from the seller/scammer. Even if he wins a judgement that is the only way he will get paid, but PayPal already paid him back for the first transaction. If the scammer lied about PayPal withholding the funds from unrelated sales in the first place then the OP will not likely see a cent
I... I just don't know. Maybe I'll miss some opportunities, but there's no way I'd consider sending money to someone who was in a situation like this, or claimed to be. No, I take it back. I might send them money to help them out, but I wouldn't expect to get anything in return.
I believe you and I met before in the 3M plant, as I was called there to resolve some equipment problems.
