Been sold counterfeit coin

I know opening a roll destroyed some value but if you pump up the end coin and it is counterfeit I feel it is a different situation. I feel like I was sold 48 mystery coins and the two identified non mystery coins. I don't necessarily think it was intentional but there is still a chance that it was. Anyway, i opened a case with eBay. I'm not a lawyer but my understanding is you can't legally sell a counterfeit when you are not clearly identifying it as such. Even if you don't know it is counterfeit I always thought there was some accountability associated in a situation even when you sell it no returns and the roll is open. </p><p><br /></p><p>I would welcome any input.
