The ad is still up. I’ll never I never understand how these people sleep at night.

 

LOL, I think it's good to be a slow learner in situations like this, as there are still many good deals there.

They sleep at night because they don't care who's getting screwed over. They only care about raking in the big bucks...... unless the seller screwed up big time and way overpaid for the coin, which I very highly doubt. It's as disgraceful as making precious metals illegal to own.

 

I sent a very nice report saying the piece was counterfeit and a poor unsuspecting soul was about to lose a lot of money… I got back a canned response. They saw nothing wrong with the ad…… Too bad.

 

There’s nothing wrong with the ad, it’s the coin. eBay is looking in the wrong place!

 

"I have made report with each details and send it to our manual investigation team and they will take action on the seller account within 72 hours." From my chat transcript. That deadline will be around 11am MST Tuesday, less than a day before the listing ends. Wait and see I guess.

 

It's my understanding that it is the federal crime of mail fraud to use the US postal service to ship any counterfeit coins or currency. This happens via eBay on a regular daily basis. Do the feds even enforce this law anymore?

 

It's interesting to contemplate the possibilities if they refuse to remove the listing. They have received multiple reports with ample evidence, including my escalation with case 6440401520. My reading of the Hobby Protection Act would be that they are knowingly facilitating the sale of counterfeit coins. To whit:

"It shall be a violation of the Act and the regulations promulgated thereunder for a person to provide substantial assistance or support to any manufacturer, importer, or seller of imitation numismatic items, or to any manufacturer or importer of imitation political items, if that person knows or should have known that the manufacturer, importer, or seller is engaged in any practice that violates the Act and the regulations promulgated thereunder."

As a civil matter, can they be subjected to a class action suit for damaging an entire hobby? I wouldn't have any actual damages since I won't be buying the coin, and the previous buyers of the 5 1889-CC dollars likely have no clue that a counterfeit is sitting in their collection.

 

Then the seller would be guilty of mail fraud.

 

But we see this day after day after day on the Bay. It is like the drug hookers on one particular short street in my city. You happen to make a wrong turn and end up on that street the women will walk in front of your car to force you to stop and be propositioned. I don’t know why the law allows it on that street but they do. If nobody enforces the law then why should the criminals care? Perhaps EBay isn’t who we should be angry with.

I guess since the higher ups in government have chosen to ignore the law the people figure why not me too.

 

It has now been the requisite 72 hours for them to make a decision on my escalated case 6440401520 and the listing is still up. Curiously, it has reduced to 3 bids and $6100, where previously it was I think 9 bids and $7250. Still has the same listing end date and time.

I suppose I could try getting on a live chat again with a real person, but I also don't feel like wasting my time. I learned the other day that someone doesn't actually have to mail an item for it to be federal mail fraud. Mailing it just has to be an intended aspect of the scheme to defraud. Ebay is skating on really thin ice here, since they've been informed multiple times that the 1916-D is counterfeit. Who will take them on though? Wouldn't PCGS have a strong interest in this?
