ANA Executive Director Placed on Administrative Leave

    Sure, you could do lots of things. Question is, how much is it going to cost you to do it and are you willing to risk that much just to post comments on a forum ?

    Seems kinda silly to me.

    The press release that was sent out is official. It was sent out by ANA IT Manager David Lighty. I'm guessing he neglected to use an official ANA email address by accident.

    The difference between speculation and making what appears to be a bonofide factual statement is pretty obvious to anyone with more than a 3rd grade education. That's not to say there aren't some lawyers who operate at a lower intellectual level, but most of them aren't too successful.

    All they have to do is cost you money and they are successful. And by filing the suit, frivolous or not, they cost you money for you cannot ignore it. You see, it's worth it to their client just to get you to shut up.

    Thanks for the warning, no doubt you are more of an expert on these things than most. Could you enlighten us on how people get summoned by something they have sounded off about on some media source? Let me guess, you get an administrative summons, a blogger/poster, etc., then gets the info forwarded to them; then they have to get a lawyer to address the issue.

    I have seen this sort of thing at an investment forum, where an administrator, Sunspotter, has been threatened by a company with a lawsuit for questioning its credibility: http://investorshub.advfn.com/boards/board.aspx?board_id=18091;

    Anyone who would be intimidated by a company with less than $300 in cash on hand and zero revenue, ought to be paranoid about nearly everything in life. Spencer Pharmaceutical is a sham company run by scumbags. There, I said it. Now let's see if they sue me!

    It's one thing to be threatened with a lawsuit, it's something else entirely to to actually have a suit filed against you.

    Anybody can threaten to file suit against you, and that, in and of itself is usually meaningless. For most of the time the threats are idle threats, meaning the person making the threat has no real intention of actually filing a suit.

    Individual members, and Coin Talk itself, have been threatened many times. And not just in a forum post either, but in emails sent privately. There were even emails sent about this thread, but I will comment no further than that.

    If however, somebody actually does file a suit against you, you're not going to find about it on the forum. You will find out when a Constable, a Deputy Sheriff, or a Police Officer knock on your door and hand you a Summons.

    First of all, I do not see why you or anyone would make such a statement on a public internet site that will be assessable for a long period of time with archiving bots scooping up everything. You are currently anonymous, but if the owner is forced legally to deliver all info IP, etc. on you, he will. Is the premise that you feel since they are money poor, a person can say what they wish, and not be worried about lawsuits. I agree the chance is almost nonexistent, but why take any chance at all, since it doesn't concern you unless you are a stockholder. I am not intimidated either, but I see no reason to publicly make such comments that once on the internet can not be eliminated. IMO.

    Now as a moderator, Please keep the posts on the OP subject.

    Rumors are NOT facts!

    I've read this thread in interest.

    All I see here are rumors and assumptions.

    The only known facts are what the parties have said in official press releases.

    The ANA is not in the sixties nor is it old fashioned. It is stepping forward, and has done so with the last two ANA Presidents, Barry Stupler and Cliff Mishler, and continuing to progress even more with Tom Hallenbeck's leadership.

    Just because you are ignorant to the facts does not make you know more than you really do.

    Anything that is not a supported and proven fact is merely a rumor, and it is time to put rumors to bed before some people think that rumors are facts...

    Just my 2 elongated Pennies worth...

    Agreed dear fellow. Put the rumors to rest.......somebody make a statement as to what the devil happened.

    Perhaps that will happen when the blood sucking lawyers are finished with their smoke and mirrors.

    I agree that someone needs to put out the facts, but it's not that simple.

    The ANA do not wish to drag this into the future with law suits and lawyer fees. I don't think Larry wants this either.

    Some things are best kept private, especially if both sides agree that it should be kept private, and any publicizing of the matter would entitle the other side to compensation.

    I have no idea if this is what happened or not, but as much as everyone's NEED TO KNOW anything and everything, right now, or else they feel deprived, some things should kept private, especially when they effect someone's life and livelihood.

    I suppose and hope that the ANA and Larry will sit together and compose a joint press release that will put this to sleep.

    In any case, i will be at the Pittsburgh Money Show this week, and will talk to Tom, Walt, etc., as well as attend the public session of the Board. Let's see what they say. or not say.

    How you could make such a comparison is beyond me :rolleyes:

    But no, he's not trying to do that. He's trying to explain to you that the lawyers, on both sides, are dictating what either side can say in public - at this point.

    So there's no great conspiracy. There's no Watergate cover-up. The ANA is only being allowed to say what they have already said. And for you, or me, or anybody else, to sit here and speculate and guess about what may have or may not have happened is a waste of time because we do not know the facts. Oded is telling you that we do not know the facts. And he's right, we don't. And we aren't going to know them, probably ever. For once the lawyers get involved what usually happens is that eventually both sides decide to settle the issue in one way or another and then the court dictates that nothing more be said about it - ever. Both sides are forbidden, by the court, from ever saying anything. And both sides agree to this.

    If they don't, then it goes to court. And then and only then do all the facts come out. But usually, neither side actually wants to go to court because it costs too much in legal fees. So that seldom happens, and we the public sit here yammering away about it, never actually knowing anything. But having a grand old time pretending that we do.

    Why don't you all stop the guessing and the rumors :arguing: and get back to what is more important - collecting coins and enjoying your collections.

    At the moment, continuing this would be as good as beating a dead horse:dead-horse:and :headbang:...
