eBay is telling me it's too early to file a "I haven't received my item yet" claim at this time.

Me as well Steve - the Seller had the absolute longest handling time and longest shipping, very curious if he intended to ship these out at all...

I would like to think that the seller intended to ship these out. I have some faith in people.

But what the seller is doing is wrong - from a legal standpoint.

He wrote "Ebay has (in my opinion)illegally confiscated all your payments with a flawed program called Buyer Protection."

Our contract with the seller (for this transaction) did not include the condition that he would win the settlement with the other buyer who filed a claim against him.

The fact that eBay put a negative balance in his account, and thereby confiscated our payments to pay off what they determined he owes, does not exempt him from fulfilling his obligations in this contract. We rendered the payment to him, based on the conditions he provided in the auction.

The money is not going into his pocket, but it is offsetting his debt.

    Consider this example:

Joe currently owes money to the bank. He has a negative balance in his bank account due to some overdraft fees that (in his opinion) the bank took unjustly.

Joe is hired by ABC company to perform a service. He is paid for the service up-front, and is given a check which he deposits into his account. Because of the negative balance, the check is used to offset his debt and bring it back up to 0. But because he feels the bank unfairly put his account in a negative balance, he does not perform the service to ABC company because he is not actually "making any money." He tells ABC company to go get their money back from the bank. The bank tells ABC company to get lost, and to sue Joe for breach of contract.

Now, the bank and eBay are not the same entity. eBay does have a Buyer Protection program. But what the seller is doing, is trying to get back at eBay by making eBay pay us back for his breach of contract. The original Buyer Protection claim has nothing at all do with our purchases. It may be that the original claim was unfair, or it was scam by the buyer. This is something that the seller needs to straighten out with eBay directly by filing an appeal. Instead, the seller is forcing eBay to fork out the money to all 145 sellers of the $2 bills. They may pay out - or they may not. Perhaps the seller doesn't realize that if he sticks eBay with the bill, he is going to end up in collections, owing more than he does now, and will likely have a levy placed on his account to pay off his debt.

A dollar was lost. I don't know if I really want to get involved in this mess over a dollar.

I like to believe people are inherently good as well, sure, but this case is very curious. I believe to become a top seller you need to have no more than one day handling time - These auctions had a 3 day handling time, ok, maybe he would list all of his other auctions with one day handling to maintain his top seller rating that he is "celebrating" with these $2 for $1 offers. He left positive feedback for me as well that I didn't like very much either: "SHAME on you EBAY, look what you did to your top-rated seller, UNFAIR" Just doesn't look very good when people search my feedback...

He may very well intended to provide this great deal to get great feedback, but you are right Funkee, he is wrong:

Probably best not to get too worked up, it is just a dollar (or two rather...)

Funkee is right. This guy is obligated to ship anything that is paid for. His buyers are not responsible for his debt. I know it's only a dollar, but everyone should contact him to tell him this. If he doesn't see the light, file a claim. He's trying to preserve his feedback and seller status on the backs of the buyers. That's not right.

I have received several emails from Terry (the seller), and have provided him a link to this thread.

One of my vices is the Florida Lottery. I spend two bucks a week. This week I will only spend one, and if I get my refund, I will spend three.

Got my email too. The seller got the shaft from Ebay, but if it was me I'd absorb the further loss of some postage stamps and mail them out anyway. But, not worth an argument over a dollar. "If it sounds to good to be true, it probably isn't".

A guy stopped me in Las Vegas one time, asked me for $1. I was offended. I'd heard/seen him ask others for, and receive from them, their dollars. The guy was dressed in nice clothes, certainly more expensive than mine. Real nice sunglasses. Brown leather shoes. I said, "You kidding me? How much you make in a year doing this?"

His reply? With a grin he told me, "Last year I cleared $30,000" And with that he walked away.

    Food for thought.

It's not the first time, nor will it be the last. The guy is slime, using innocent, naive, yet trusting strangers, to push his agenda against Ebay, causing possible problems for the buyers. The old adage about " if it seems too good to be true, it probably isn't true". You just alerted it to people, you are not responsible if they did it.

File with Ebay to get the feedback removed. I'm sure they'll do it in a heartbeat!

I've been all over Ebay trying to do this, but since we have to wait till Oct. 17 to file a "not received" claim, I can find no way to just message Ebay about this whole mess. This feedback in my profile ""SHAME on you EBAY, look what you did to your top-rated seller, UNFAIR" with a red star really has me grrrrrrrrrr!

Is there a way to send a general message to Ebay asking for help with this? I can't find one.

I agree with Jim, and it was obvious (to me anyway) that this method of "celebrating" was totally flawed (see my post #4); the brunt of the seller's agenda is the eBay "buyer protection" program. All of his current auctions contain an abreviated version of the email rec'd by the "buyers." His modus operandi will result in his ultimately being NARU'd, which is probably what he wants anyway.

I realize you are stating that with a little sarcasm, as getting "positive" feedback removed is a difficult task to say the least. However, in this case, carrying ones's agenda into the buyers feedback oversteps the bounds of eBay's policy of "turning their heads the other way".

I found a way, but don't ask me how I did it - something concerning fraudulent feedback.
