As far as I am concerned common decency should keep a person from using another persons work - even if it is a photograph. Personally everything I have read states that digital photographs are copyright protected. So I will play it safe and use that interpretation.
I don't have to. I have my own lawyers and I'm in DC about 8 times a year for Lobbying and congressional hearings, department of commerce meetings et al. I don't CARE what Lorraine says. I don't care what she has to say, and I don't care about anyones twisted idea of of what should be a protected work. What I DO care about it that the entire 20th Centuries history is theoretically under copyright, and illegal to use any primary source examples except for government records and that Girl Scouts get sued for singing happy birthday. What I DO care about is that people, such as people on this forum, have the right to discuss, ridicule by example, critique, archive for future use, and can make derivative works, BECAUSE EVERYTHING IS A DERIVATIVE WORK and NOTHING is completely original, off all kinds of information so that they can participate freely in a free world. Just call me crazy. Jack Valanti did before he croaked but the CEO of Phillips ripped him to shreads for it for great fun of the entire judicial subcommitee. Imitation is the best form of flattery. BTW if ANY web designer was really a great computer geek, he or she could prevent most people from lifting a photo from a websitel. Actually, I spoke to my web desinger and she said it is EASY. All you have to do is program in a special code.
I checked with my expert. While see agrees 100% that a computer geek can copy any image, there is a computer code you can program into an uploaded photo that would prevent the "average joe" from copying the photo. Specifically, the code will disable someone's ability to simply capture the photo by clicking their mouse on the photo, then clicking on the word "copy" . . . that EASY TO DO FUNCTION is disabled by the code. I am no expert on computer science, so I am not in a postion to debate this science. However, my expert told me that a lot of the adult porn sites owned by organized crime utlize tricks to disable simple functions of a web broswer. For example, she points out that recently a Gambino crime family website that was busted by the feds utilized a computer code that would disable the BACK BOTTON on your browser, so you could not leave the site without logging off.
That is a javascript function which can be gotten around in many ways. Turn off javascript, check the active cache, view the source code of the xhtml and pluck the photo individually, etc. hmm use firefox.
There is No Way to keep a picture from being copied. You can use Java to intercept a right click or you can overlay the photo with a transparent image that would be picked up in a copy attempt, but the thing that will defeat all methods is Screen Copy. Just copy the screen with the photo (use Snip with Vista) and use Paint or Photoshop to erase everything except the picture that you want. There are less desirable and somewhat self-defeating ways to limit copying such as only posting small photos, or lo-res photos, or using a watermark. These methods just make the photo you are posting harder to see and limit the appeal of what you are trying to show. In general, if you don't want someone copying your photo, then don't post it. Once it is posted, it's out there forever.
Yeah that is true. Until they get that DRM infested hardware on your PC they can't stop you from doing a screen capture. And then there an external camera. Ruben
