Always try to match die markers. Also, the doubling needs to match exactly. Not just "kinda looks the same". Remember, it either is or it isn't.

Dude. The second is just a normal 1939. Those you can find fairly often in good condition. The first coin you posted is the 1939 Doubled Die...
