Try submitting it to NGC. Yeah - more grading fees, but if it stills comes back in a details slab - maybe it is. From the pictures it does not...
Did you call and ask them if you could submit it in the original packaging? And yes I know even in the original packaging someone could tamper...

Looks more like a ground discovery that has been cleaned some.
I think I like 45, 40, 40 as the grades based off the pictures. Actually like the first one the best.

Actually kind of surprised they said rim damage - seems to me I have seen worse in non-problem holders. Still at 38 dollars nice coin.

To me the coin is ag-3, to me the slight rim dings kind of hurt it. NGC would probably be G4 to G6. A really good deal at $38.
