Actually in a case of controversy this long in the tooth, it does precisely do so. Were this an issue that came along freshly rather recently, EAC would be correct. Under these circumstances, he's nuts. Every day that passes without court intervention, Dan is in less and less legal jeopardy.

I simply do not understand the emotionalism of Dan's opponents. What is it to them? Why do THEY care? [By the way, these are the questions the judge would ask at the prelim hearing stage.] Any private complaint against Dan would be wiped out on the first response to pleadings.

Something that is not useful when a unique fact pattern is implicated. NO ONE ELSE ANYWHERE is doing precisely what Dan is doing. EVERYONE ELSE is doing something a bit differently in ways that matter greatly.
Anything that might have been dismissed on the pleadings won't even have a citation. I don't know of one in particular; I'm jus' sayin'. To be researchable, it needs to have more than just a Complaint, and would need to be a published Opinion.
