Yeah, as soon as a bad coin or bad listing is reported, USACB gets right on it. After testing the waters with USACB for a year or so I gave up selling on eBay a few years back, and I can honestly say I’m better off for having done so. I do still buy on eBay occasionally . . . Who ever said I was a fast learner?
LOL, I think it's good to be a slow learner in situations like this, as there are still many good deals there. They sleep at night because they don't care who's getting screwed over. They only care about raking in the big bucks...... unless the seller screwed up big time and way overpaid for the coin, which I very highly doubt. It's as disgraceful as making precious metals illegal to own.
I put in a lengthy a report in last night, but somehow changed tabs and ended up reporting the wrong item. EBay just came back with a finding that there’s no violation, after which I realized what I’d done. Trying to do too many things at once! “Multi-tasking” doesn’t work for me . . . Time to go back and do it right this time.
I sent a very nice report saying the piece was counterfeit and a poor unsuspecting soul was about to lose a lot of money… I got back a canned response. They saw nothing wrong with the ad…… Too bad.
"I have made report with each details and send it to our manual investigation team and they will take action on the seller account within 72 hours." From my chat transcript. That deadline will be around 11am MST Tuesday, less than a day before the listing ends. Wait and see I guess.
It's my understanding that it is the federal crime of mail fraud to use the US postal service to ship any counterfeit coins or currency. This happens via eBay on a regular daily basis. Do the feds even enforce this law anymore?
It's interesting to contemplate the possibilities if they refuse to remove the listing. They have received multiple reports with ample evidence, including my escalation with case 6440401520. My reading of the Hobby Protection Act would be that they are knowingly facilitating the sale of counterfeit coins. To whit: https://www.ecfr.gov/current/title-16/chapter-I/subchapter-C/part-304 "It shall be a violation of the Act and the regulations promulgated thereunder for a person to provide substantial assistance or support to any manufacturer, importer, or seller of imitation numismatic items, or to any manufacturer or importer of imitation political items, if that person knows or should have known that the manufacturer, importer, or seller is engaged in any practice that violates the Act and the regulations promulgated thereunder." As a civil matter, can they be subjected to a class action suit for damaging an entire hobby? I wouldn't have any actual damages since I won't be buying the coin, and the previous buyers of the 5 1889-CC dollars likely have no clue that a counterfeit is sitting in their collection.
But we see this day after day after day on the Bay. It is like the drug hookers on one particular short street in my city. You happen to make a wrong turn and end up on that street the women will walk in front of your car to force you to stop and be propositioned. I don’t know why the law allows it on that street but they do. If nobody enforces the law then why should the criminals care? Perhaps EBay isn’t who we should be angry with. I guess since the higher ups in government have chosen to ignore the law the people figure why not me too.
I reported another Chinese counterfeiter / seller to eBay . . . as obvious as this seller's fakes are, eBay just gives us more of the same level of satisfaction, so I reported just one of his coins one additional time, as follows: This puke makes fakes and abuses eBay buyers while eBay holds its nose and looks the other way. This "coin" has a Seated Liberty Dime obverse and a Barber Dime reverse, and eBay's team of "qualified" customer service agents can't catch something as simple as this? You should be ashamed . . . no, worse than that . . . I just can't think of the word right now. If you won't clean up this mess you've created, eBay, you can kiss my arse goodbye. There are plenty of other internet sources I can more efficiently buy from by elminating the time I waste checking for deals here on eBay. My sincerest hope is that others will join me in my cause. This outfit has gone from the 900 lb gorilla in our industry to a 900 lb pile of steaming, stinking excrement.
It has now been the requisite 72 hours for them to make a decision on my escalated case 6440401520 and the listing is still up. Curiously, it has reduced to 3 bids and $6100, where previously it was I think 9 bids and $7250. Still has the same listing end date and time. I suppose I could try getting on a live chat again with a real person, but I also don't feel like wasting my time. I learned the other day that someone doesn't actually have to mail an item for it to be federal mail fraud. Mailing it just has to be an intended aspect of the scheme to defraud. Ebay is skating on really thin ice here, since they've been informed multiple times that the 1916-D is counterfeit. Who will take them on though? Wouldn't PCGS have a strong interest in this?
Two bidders tried to snipe it at the end but a 6:30am bidder put in a strong maximum. I just hope it was someone on here who then refuses to pay because it's fake. I will never buy anything from ebay again. I feel sorry for the legitimate sellers on there as I have purchased many coins there in the past.
