Just got this email from JM Bullion after purchase of 1 OZ Gold Krugerrand

Actually you did more than state your experience.

You stated your experience (you bought a gold Krugerrand. JMbullion informed you of sales tax issues, so they wouldn't sell you the coin. They refunded your money) but you also stated your opinion of their intention behind those actions. You said they didn't sell you the item because the price of the item increased after you bought it, and that they engaged in "dishonest business practices."

You are not entitled to publicly slander a company by attempting to ascribe intentions to their behavior when you have no evidence to support that assertion.

You do have a right to state your experience and how it made you feel.

 

Facts are seemingly less important by the hour. The norm is now staking a position and cobbling together justification later if needed. WAGs are usually more entertaining anyways.

Your other post do not agree with what you wrote here.

 

Definition of the word FACT (noun, pronounced /əˈsʌmp.ʃən/ ): Something that you accept as true without question or proof

Example: The sales forecast is predicated on the as... errrm FACT that the economy will grow by five percent this year.

You're being highly defensive in your posts. Please take a minute to try to understand your mistake. Do you understand what you did that was wrong?

Again, you are entitled to state how you feel. You are also obviously entitled to state the facts. But, you are not entitled to attribute intention behind another person's actions without evidence. You have just publicly slandered JMBullion.

Nevada sales tax would have been over $100 more meaning you would have likely opted for the +$80 option anyways...

Let them figure out what the state is going to make them do and give them time to push back as best they can. Given JMB's size, this is probably not a simple task to sort out. Like most all other retailers out there, JMB will side with the consumer and try to offer the lowest possible net price (e.i. avoid unnecessary taxes and fees where possible).

I just received an email from JMB that they are once again accepting orders and shipping to Nevada. Wonder what resolution they came to. The email did not have any additional information of product restrictions.

There really aren't any points that aren't very straightforward and easy to comprehend in the State of Nevada coin (and stamp) taxation mandate. For convenience sake, here is an even more simplified version of the official text:
A. Any coin used as a medium of exchange and sold at less than 50% above face value is not subject to taxation.
B. Any coin used as a medium of exchange and sold at 50% or more above face value is subject to taxation.
C. Any coin not used as a medium of exchange is subject to taxation.
D. All bullion sold at face value and used as a medium of exchange is not subject to taxation.
E. All bullion sold at a premium and used as a medium of exchange is not subject to taxation.
F. All bullion sold at a premium and not used as a medium of exchange is subject to taxation.

 

A. A written act cannot be termed slanderous; slander must be oral in nature.
B. A written defamation is on the other hand called libel, and then only if it is done maliciously and with the intent to harm.
C. A personal opinion as such cannot be considered libelous, as it is just an expression of someone's experience.
D. Neither libel nor slander are considered offenses to be prosecuted by the state; these charges can only be brought to bear as a private lawsuit and adjudicated as such.

 

Anyone is entitled to their opinion whether or not anyone else agrees with it or not; that is called freedom of speech and is enshrined as such in the First Amendment to the Constitution of the United States. It is not up to anyone else to decide what a person is entitled or not entitled to say, here or anywhere else, or to be the judge and jury of what kind and/or sort of statement that person is making.

 

You have no clue what freedom of speech means. It's when dealing with the government.

Furthermore you do NOT have freedom of speech on this forum....try typing a cus word and see what happens.

 

Freedom of speech has nothing to do with private entities, the workplace, schools ect. It can and is limited everyday. You can't just say whatever you want where ever you want and claim freedom of speech
