I have a question about U.S.Coin(s),HELP!??!

    I know most publicly available images would fall under the Fair Use Doctrine. It depends how you plan to use the images. Including them on an online forum like this or on a set registry should be o.k., however you would want to note the image source. Using them in an eBay listing... Now that's iffy.

    The problem is the Digital Millennium Copyright Act (DMCA). The copyright owner files a complaint with our host and they must take down the image. Period. Doing so is part of the "safe harbor" provision that prevents the site from being sued.

    Now there is a part of the law that allows you to then file a counter-complaint. But that's not as clear - most sites won't bother getting into the middle of a he-said she-said copyrightfight.

    All predicated, of course, on the auction house filing the takedown notice. If they don't care, then nobody else does either.

    You guys remember the brouhaha over the enhanced (2013) ASE pictures a few years ago? Seems early on there was an author over on ask.com who had the only pictures of the soon to released coin and some folks here were borrowing the image and posting it here, on these forums. The owner contacted Peter and had the images removed. My thoughts at the time was the guy was being petty. I still feel that way. Anyway, the coin was soon released and folks started posting their own images.

    One of my favorite personal sayings: "Screw the law." Heh.

    Anyway. I personally love an item with a good story. If I like the salvaged pieces, I would buy the salvaged pieces. Same for choice specimens. Make the best deal for the best value that you can and let the "investment" end of it take care of itself.

    A few months ago there was this guy that posted an image on all the forums. He did not like the opinions he received so he took down the images. I put them back up and he reported me to everyone but God. Just goes to show that you can get in trouble if you post an image you don't own.

    I think the guys discussing the photo issue aren't trying to take the fun out of this -- they are trying to keep the site where we have fun out of trouble......

    The site won't get into trouble. First, all CT has to do is respond appropriately to a legally-tendered request to remove an offending usage, and they're fine. Second, coin images can't be copyrighted. We're discussing this here:

    Then go to that thread, and contradict the law we're quoting there which disagrees with you. Present evidence. I will cheerfully change my mind in the presence of appropriate evidence.

    SuperDave - I agree with you that even the deliberate use of someone else's photo would NOT trigger an apocalypse for CT, but, instead would require pulling the photo upon appropriate request. Apparently, the laws of SANITY no longer apply to this topic. This has become an un-winnable discussion. Jack
