I was reading in Coin World that defendants PCGS, ANA and ICTA have motioned for a dismissal of the lawsuit ASA Accugrade filed against them on December 17, 2004. Reading over the details, I had to laugh that on-line forums (like this one) were some of the basis for ASA's lawsuit contending PCGS furthered a conspiracy against ASA Accugrade through two activities: 1.) Hosting an on-line message boad where non Collector's Universe affiliated members made defamatory statements concerning ASA Accugrade. 2.) Concocting "bogus" PNG/ICTA coin grading surveys in 2002 and 2004. According to the defendent CU/PCGS, these allegations simply do not state a claim against CU/PCGS under the antitrust laws, or anything else for that matter. Here's the good news for Peter and owners of forums like this: The owners of message boards are "immune from liability for defamatory statements posted by others on its message board as a result of the Communications Decency Act of 1996,...which provides that 'no provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.' " As I read about this case, it is my opinion that ASA Accugrade is really reaching and their lawyers are probably going for as much billable hours as they can accumulate. Just another headache in the "How you been hurt or injured?" society we live in. This is all the reason why "loser pays" will help stop many of these ridiculous lawsuits from even taking place. I'm telling you exactly what is happening right now with ASA Accugrade's lawyers...they are either looking to see how long they can "milk" their hours OR they are proposing a settlement with the defendents so they can get out with 30 to 50% of whatever settlement. A bunch of nonsense and waste of time/money if you ask me.

Usually a lawsuit such as this one is taken on with the lawyer geting a percentage of the settlement. Drawing it out to add more hours just adds to their expenses without increasing their revenue. I doubt if the lawyers are doing much more than trying to get a settlement out of the defendants.
I was afraid to post this Q across the street....but how do we know this (lawsuit)(allegations) are BS? Just wondering! TIA
