Looks like something scraped it pretty good. All the damage is in a straight line. I doubt it was opened. With that said, if you could not see the damage when you bought it, and it was not advertised that way, I would send it back for a refund.
the seller has agreed to ship me a new one. problem solved. I will be buying from him again as I can trust if I'm not happy he will make it right
