I lost over $20 due to eBay's "Buyer protection".

    I'm on the fence with this one because it's never fun to get something other than what was pictured, but he did get what was described.
    Bottom line, it was a gamble and you win some, you lose some.

    I believe the seller was wrong (or possibly unethical) in how the listing was presented. However, rather than assuming he would be getting a bargain at the seller's expense, OP should have asked the seller if the coins for sale were the ones pictured. Sometimes sellers reuse listings and change the title but forget to remove pictures. Mistakes happen. Above that, the seller agreed to take the coins back, so the OP should have sent them back with tracking.

    Lastly, this thread is more a complaint about using money orders on eBay than one about eBay Buyer Protection. The Buyer Protection system works as intended: It protects buyers who use Paypal against fraudulent transactions on eBay.

    I feel for your difficulty but the title said what you would get and you could have asked the seller if there were any 1940's in the pile. Could be that's how ebay sees it as well, IDK. Still a bit lost on why you didn't accept the refund offered, maybe I'll read it all again. Hope all works out.

    The seller should have never sold you anything in the first place.
    He should have known it would turn into a problem.
    It's all his fault.

    Tim,

    Why didn't you write the seller and ask about the discrepancy between the photo and the description? I've done that many times with items that appeared to be what I was looking for based on one or the other. Quite a few times, they corrected things and I learned it wasn't what I was hoping for. Other times it confirmed it was the right item and I then placed a bid.

    Bottom line, you gambled....and so far you've lost. You should be able to get your money back, but without Paypal, you may be at a disadvantage.

    Tim...what have we said before about taking risks on auctions? It seems like every time you take a risk with a listing, you end up on the losing side. What does this tell you? Surely you should at least take away that you of all people should not take risks...just stick to buying coins you are confident in!

    One more reason why I do not use Ebay....However I do have to agree that I would have held on to the coin and waited until i heard from the seller before sending them back. Not all sellers are bad on ebay, but the ones who are, are ruining it for the good ones.

    I agree that you should have contacted the seller about the date of the coins . The description did say coins from the '50s so you really don't have a case . Still the seller should have used the correct photos . Think of it as a lesson learned and a relatively cheap one .

    I've been wondering, why did you assume that the final price is reflective of such an assumption? Don't VF20 1950s sell for 75c-$1 ea? That would give a retail range of... $24.75-$33, wouldn't it? If you really felt the seller made a typo, why didn't you bring it to their attention? If others had assumed the lot was 33 coins with $1 of silver content ($1.50-$3 ea retail), I'm fairly certain it would have fetched at least $10 more.

    Detecto is blaming eBay for his mistakes... buyer protection works quite well if you "bid & buy" correctly. Read the rules, Tim... skirt the system and pay the price.

    In the listing the seller never said that the coins were the ones you would receive.

    NEVER (on eBay) return items to a seller without first opening a case.
    And when you DO return them ALWAYS use tracking.

    That's the backbone of Buyer Protection.

    If the seller agreed to a money back return and you returned the item, then you should get a refund. Seems pretty straightforward to me. I'm not sure how anyone can disagree with that.

    To those arguing about the listing details, that's not really relevant to the basic issue here which is that a refund should have been provided. That said, eBay's policies are clear that any photos included in a listing must be of the actual item being sold. If you're a buyer and the listing seems ambiguous then it does make sense to ask for clarification, but it's not required. Frankly, it annoys me to no end that some sellers seem to constantly get away with skirting that policy.

    This is true, but if the seller never received/receives the items back, should they still be responsible to refund the money?

    Is this directed to the OP or those who keep responding in hopes that he'll change?
