No, the date is incused, but the raised portion of the numerals (cut into the dies) is missing. It is that portion of the date and lettering in the design of the tooling (dies) which ensured a quality impression in the event of inadequate strike pressure, or a local delamination of the planchet. - Mike
Doesn't seem to be in much of a hurry about it, though. Of course, if I were in his shoes (new seller, don't know coins, someone I've never heard of tells me it's fake), I might be hesitant as well.
He also sent me images of an 1868 $3 Gold he was about to list. That coin is also no good. The numerals in the date were of the wrong geometry, and far too small for an 1868.
This is a decent fake. Not the best, not the worst. Good enough to fool most. I still think it is scary how many fakes are out there.
Wonder if it has any gold in it . Maybe I'll message him that it's a fake . If more than one tell him he would be more inclined to remove it . To bad a new seller has to deal with these fakes , but he should learn what he's selling .
