ACG Sues RCC

    Maybe no one should talk about the grading services on this forum and just give each other private e-mails on the matter without using the forum for it. Would it help you Peter to make an official disclaimer in regards to this topic not being an acceptable topic of discussion in an attempt to protect yourself and therefore the availability of this forum to everyone else. I for one am for free speech but with some people and some lawyers free speech comes with a price in the public venue. I believe GD mentioned something about this last year happening to another site?

    I've never censored free discussion on CoinTalk in the past, and if someone has a comment about ACG they can make it as long as it doesn't violate existing guidelines such as being uncivil. I know that there is no conspiracy here at CoinTalk, against any company or individual. My name is mentioned in that document, but not because of anything that's happened here at CoinTalk. Either they don't know that CoinTalk exists, or they simply didn't find anything here to be offensive to them. They certainly know *I* exist.

    Well Peter...the U.S. has 5% of the world's population, but 90% of the world's attorneys. We live in a day and age that people sue for that lottery payoff, whereas your local trial lawyer will pocket 30 to 50% of whatever settlement. This is another reason why we need legal reform and "loser pays".

    I laugh when I read the complaint because I guess it is alright for professional graders to give opinions of coins, but heaven forbid if you offer an opinion about another company's product and service.

    ACG has failed in the marketplace because the coin community and marketplace has spoken...and collectors/sellers are NOT buying. Instead of trying to improve their product and service, they resort to the "have you been hurt or injured?" lawyer ads and answer a resounding, "Yes!"

    So what is going to happen? Thousands of dollars will be spent, lives will be dragged through the mud, and both attoreys will celebrate their billable hours over drinks at the nearest court house bar in Orlando.

    Wow. It is not often that one comes across an idealist. It is nice to know that it still exisits. I still have some traces myself but most of it has either been beaten out or eroded over time. Thanks for shining that light Pete.

    The sad thing is that the wonderful legal system that we do have is being misused by some to bully people. The threat of a lawsuit could mean bankruptcy for an individual or small entity. It could drag out for years and as Ed stated with "billable hours" plying up to defend yourself your cash could be gone before you ever get to trial, if it even ever gets there. Sue and drop technique is bad news for everyone.

    It seems to me that, if they truly wanted to win this thing, they wouldn't have dragged in the big guns as defendants. Personally, I think it's a play for publicity. Long after the details of the case are forgotten, their name will be remembered.

    Agreed, and I said as much yesterday elsewhere.

    It seems like a BIG mistake for the plaintiffs to add deeper pockets -- and the added legal firepower they bring -- to the list of named defendants.

    Perhaps so. There has to be a rational reason for doing this. From a legal standpoint, doing something that allows the defense to bring in the heavy artillery is probably a loser.

    Some people say there's no such thing as bad publicity. I'm not sure, but maybe that's what they're thinking...?

    like andy ive also had some goodness whipped outta me by life, the reason is in life you look all around and it seems its the crooks that get the cherry.I wont let them beat me though.

    I think education has to be the main thing here,the sooner novices are educated the better.People should be spreading the word long and far.

    I'm still relatively new to coin collecting as compared to many of you on this board and for me to hear that ACG is doing this gives me a negative perception about them (and from what I hear, this is not the first time they've weilded the lawsuit dagger at the mere mention of their name in a manner they felt was negative). So I personally don't think this is good for them and their reputation in the hobby and/or market. If I hear that someone has a coin graded by them, I'll pass it up. I'd rather not contribute to them in any manner.

    Just an opinion from a new collector concerned about the hobby...

    Lawsuit Fear...!

    You know this is getting a bit out of hand when we start talking about being afraid to say something against someone or something because of a possible lawsuit..!

    Schools have lost the ability to displine out of order kids.. They don't want to get sued...We have a mess in our schools. You can't spank your child for doing wrong because your afraid you will go to jail. Your afraid to have people over to your house because they might find a way to sue. This has gotten out of hand.

    Let me say this. The first amendment gives freedom of speech. Not only to the newspapers but to me as well. If I want to express my opinion about a person or company I will do so under that right.

    As far as Accugrade goes. I wouldn't purchase anything from those people if they were selling a dollar for a penny in one of their slabs. In my opinion I don't think anyone should be buying their product. If people didn't I don't think we would have this problem.

    One of many stories. This was around eight years ago in Manhattan. I know someone has a gun. He even had an arrest record with gang membership cited. Threats were made. I disarm that person and that person got his feathers ruffled alittle. Police then come and arrest that person. A civil law suit was filed against me for the reason cited that I did not actually see the gun until after the fact so the physical contact was not warrented.
    We live in a world where what used to never make the courts is now choking the system. I just feel that this is a nice place and I hate to see it potentially sued out of existence. But none of that is up to me and like I said, I respect Pete for creating this site and for what he does with it.

    Way to go Catman...I think alot of people don't know about their rights and some think that the newspaper is the only one that has that right.

    Back to Coins.

    Peter I'm sorry you are dragged into this...hopefuly ACG will soon see they are going at a losing battle.

    Cool. This may be the catalyst for coin market reform. There are some people out there who are LEGALLY ripping people off by over hyping coins, over-grading coins and making them look officially slabbed, giving many folks the opinion that regular coin dealers who only offer pennies on the dollar paid for these high priced items are trying to rip them off. 'Bout time!

    Once the 'big boys' in the coin industry get slapped with a lawsuit for slamming a slabbing company, then reform can't be far behind.

    FOR THE RECORD, I AM NOT POINTING THE FINGER AT ANY PERSON, GROUP, OR COMPANY WITH THESE STATEMENTS. I DO NOT FEEL THAT ANYONE IS BREAKING ANY LAWS. I LOVE EVERYBODY!

    Well, this publicity will not do them any good. It appears to me they are hoping for a big judgement / settlement and then will likely exit the grading business completely, win or lose. Another indication of this is that they are selling predominantly NGC graded coins on their Ebay business (note PCGS is a named defendant, but not NGC).

    Peter, is RCC still an active forum, or is it just archived somewhere? Ive asked this elsewhere and can never get a straight answer.
