IMO because of its potential value, no one should be guessing.
It should be in a PCGS or NGC slab.
Then you don't have to guess.

I personally wouldn't buy it unless it were in a slab.

MS-64 I don't see any wear in the image. Very few hits on the obverse.
The soft strike on the reverse is normal. A more rounded boot would make it better to me. Eye appeal? It's off the chart. Really nice coin.
I would not argue if some are thinking AU-58. The image could be hiding something.

Wow Wow Wow! At first glance and without a closer inspection, I would say that this Commemorative is rarely, available and offered in this condition. MS 64+ ? The Reverse is superbly toned and well struck. Please let me know, what grade this is being offered in and the asking bid. ( not that I could afford to bid on such a coin ) just for my own information. Thanks.

Oh I think we are more in line with the upper MS grading Ruben.

The toning on the REV. is really nice, and I like the way it looks.....however, the eye appeal on the OBV. is the pits IMO.

What stands out to me as soon as I look at it is....the line/mark, coming out of his nose, and the black spot by the AM in AMERICA.

The Obverse marking which you find distracting, is very typical for this issue. Overall, for me it's still a 64+

These are well known for poor strikes so I wouldn't be surprised if it makes MS-66 but MS-65 shouldn't be a problem. :thumb:

    Delicious! :eat:

I'd like to have more experience with the commem for a more accurate grade but a mid grade MS (63,64,65) doesn't seem far fetched at all.

MS-64. I would not be surprised if the TPG gave the coin a bump to 65 due to toning (eye appeal) but I think they slabbed it 64.
