I have been on this sellers case about him trying to sell a coin as a proof that to me appears to be an early die state business strike intended for general circulation. He continues to relist it even after eBay has agreed with me.

This is an educational post, not to name the seller, but to learn to tell the difference between a proof nickel by the rim characteristics.

The seller says this coin came out of a proof set. That proves nothing as anyone could assemble a set of 1938 coins and put them in a Capital plastic screw-down holder for proofs and sluff them off. It may have even been an honest mistake along the way but I'd like to see the rest of that set.

Notice on the top and middle left images that the rim is rounded and the rim slopes downward into the field of the coin that is misrepresented.
On the bottom and middle right the rim is sharp and square and has right angles at the edge and leading into the field from the top of the rim.

Outstanding Toned 1938-P Jefferson Nickel Five-Cent Piece - Mint State

The seller has finally conceded to both eBay's opinion after several removals and my stance on this coin ( item 360478745162 ) and has listed this coin as a MS coin.
I feel is still a slider in AU55 to AU58 and is listed at $40.00 or best offer. Probably worth around $12.00 at best.
You can see by the hits on Jefferson's face and that dark spot on the field behnd his head it is the same coin.

Wow... Looking through his other sale items, I am speechless.
Coins worth little, if anything over melt, and he is asking 15x melt.
    1964 Dimes.... for 20 bux!?!
    A 58-D Quarter for 300 bux!?!

Some of the ugliest toning ever, on the most common coins, and he is using words like "Magnificent" to describe them.

This guy is close to me too... I know better than go to his shop now.
