You got me wrong im not advocating doing that.. I just want to know that if i buy a silver proof set from that mint that there is some protection against receiving clad coins and if i should check the coins to make sure they are silver.
I'm not suggesting that is was your intention, but rather the threat of prosecution that deters others from the activity you proposed, however, if you felt I implied that it was your intent, then consider how you phrased the question. I suppose anything is possible given the scenario you suggested being concerned about, but a remote one that I do not think you have to worry this much about. Again, if you want to ensure that you are not receiving returned merchandise, then its best to order early, near the time the sets go on sale or set up an automatic subscription to receive one as soon as they are released.
Highly unlikely through the U.S. Mint. Much more likely on ebay. You always want to check the coins you buy. TC
I think we are getting hosed by the Mint. Business law states that if you cannot use something for the purpose that it was purchased for, you get your money back. That is unconditional, too. If you cannot sell this as Proof undamaged, you have a right, and an OBLIGATION, to demand to be made whole. Which is all flowery talk for getting restitution for moneys spent. If enough of us challenge that marginal return period, I think we could pull the rug out from under their logic flaw argument. Not allowing us to be made whole by making us pay for our return shipping is a prior restraint on recovering our damages. They cannot keep us from seeking our money back, and a simple three person class action suit, costs less than three hundred bucks. Or, alternatively, three hundred complaint letters. That'll cost them weeks of their administrative lives, which is like YEARS working for the government. Very untidy thing, answering a well constructed administrative complaint, and the blemish they suffer is lasting, and permanent. Nothing worse than ignoring the people who employ you, IMHO. Federal buildings suffer the minutes of their weekly meetings.

I wouldn't do that if you are sending them back to the mint. Attempting to defraud the US Government is seriously frowned upon. On the other hand it DOES happen sometimes on ebay. People have bought silver sets and received sets that have had the silver switched for clad, and some sellers have shipped silver sets that were returned with switched coins. (Tissue test works real well here to make sure very quickly that coins have not been switched.)
Even the tissue test is pretty hard to see, i would just use a digital scale there should be a notable weight difference between a case with silver vs clad.
