Is it "ebay legal" to rescind on a sale? If I were you, I'd make him stick to his word. The seller knew the chances of selling on ebay. He could have set a reserve, but he didn't. If you had bought it for twice what it was worth, would he have sent you a check to cover the difference? By the way RDW...we're neighbors. Howdy.
I noted that he commented in his listing that he doesn't know if it is real or not. Do you have any reason to suspect that it is fake? I know nothing about this series. Tell the seller that if he doesn't complete the transaction that you will have no other recourse but to file a complaint with eBay. Be nice! Chris
Probably the only reason he wants to cancel the sale is because He didnt get what he expected at auction! This happens alot! People think there going to get big money and when they dont They come up with some excuse! I would pursue this through E-bay if they dont do anything about it, I would explore it myself If you think something going on and it,s not kosher leave negative Feedback, If he dosent the right answer or blows you off entirley I myself would not hesitate it just doesnt sound right to me! Also dont let him know that you are going to leave negative feedback E-bay will view this as feedback extorsion and cancel the transaction And you may get in trouble! (Funny how that works!) :desk:
tell him you are going to take legal action if he doesnt go through with the sale. I have done that numerous times and it has worked out in my favor.
I didn't know it was ebay legal either, but I did not mention that the request to cancel was made thru the ebay resolution center!, so I guess it is. I could either accept or deny his request . BTW, Howdy neighbor back:thumb:
The only thing that does not look right is the color, but as he also mentions he scanned it and in my experience colors never come out right on scanned coins.
Deny his offer to cancel and take posession of the coin. It's yours. It's a tough lesson for him to learn but yeah ..these $.01 and $.99 auctions often come back to bite you. Oh well ...his loss is your gain. Enjoy !!!!
Knowing the reason as to why he wants to cancel would be the key. Maybe he wants to cancel the sale because he knows it's fake? Perhaps a potential bidder contacted him during the auction and told him it was fake and explained why. I mean, maybe people didn't bid on this for a reason? But more than likely by him questioning it's authenticity in the auction, it scared off most potential bidders, so it went for way less than what he is willing to let it go and has seller's remorse. -LTB
If you don't have the coin he can do what he wants and all you can do is get your money back and then file a complaint.
I wouldn't let him cancel it without a really good reason. If you suddenly had buyers remorse I doubt he would let you out of it. If he wanted more for the coin, he should have started the auction higher, those are the breaks.
Decide whats more important,your rights or his feelings,if he has any. negotiations will decide weather or not to drive the nail in his coffin.you still have feedback to leave.
Then he should have canceled the auction before it ended. Wrong, eBay auctions are legal binding contracts, they are just as good as any other written contract, which the OP could use in a court of law against the seller.
The thing of it is, this is an online auction with no auctioneer controling the bids. The seller knew this going in and took the risk they may not get what the coin is worth. Make them stick to the deal. Tell them if they renege on the deal you'll report them to eBay and they will be blocked from selling anything on that site again.
Just one of the many reasons I avoid ebay. My suggestion is as long as you didn't loose your money, just move on and forget this entire thing. For the money and item involved, it's just not worth your time to continue trying to accomplish anything. One reason people get ulcers. Yes it sure would be nice to figure out how to blast him on ebay, place a thing about him on FaceBook or some other web site. Even file a law suite just to irritate him but in the long run, don't waste your own valuable time.
I'm sorry to have to say this but e-bay won't block him from selling more items. The only thing that might get blocked is you from bidding on his site again. Report him, get your money back and leave an appropriate feedback.
I hate to disagree with you but, yes eBay will block him from future auctions. I have made it happen with purchases I've made and the seller tried to renege the deal. They no longer have an account with eBay as their ISP# has been blocked from registering an account. It can happen!
