I cant answer that question without seeing the coin in hand. The only way I would ever resubmit an AU58 in hopes of a mint state grade is if after hours of examination I could still not find any definitive signs of wear. My guess is that once you see the coin in hand, the wear will be more visible than in the photos.
chances are that this coin has already been through the whole crack-out and upgrade process. In my experience, coins in AU-58 slabs are as upgraded as they will get, and any attempt to upgrade it further is more or less a crap shoot. It is also my experience that many knowledgeable collectors prefer the AU-58 slabbed coin to the MS-61 coin for reasons that have been discussed on this forum ad infinitum. If you like the coin, stop treating it like an investment. Own it as a coin. The slab is the slab and it says what it says. Question is: Do you like it? The TPGs opinion is just that, another opinion.
I agree that for many an AU58 is preferable than an MS61. However, based on the look of this coin from the photos, it's either an AU58 or an MS63/64 (as the best sliders should be). That said, I agree with some of the previous posters in thinking that Heritage or the consignor would have tried to upgrade if they really thought the coin was Mint State. Additionally, dozens and dozens of expert coin people had the chance to view this coin in hand at the auction. Assuming some of them looked at this coin, if only one of those people thought it was really an MS coin, the coin would have cost you more than what you paid as they would have bid stronger on it. Your best bet is to study it closely on your own. If you can't see any wear on the coin, then take it with you to the Long Beach show and show several dealers/experts and get their free opinions. Even show it to David Hall when he does his free coin review at the show. If a few of those folks tell you to resubmit, then maybe you should. If most tell you that it's an AU58, then it most likely is.
have to agree on the ms likeness but if you try to break it out of the slab you run the chance of 1 finger print 2 letting it fall most acc happen at home congrats on the buy dave
If you decide you want to resubmit for whatever reason, 100% DO NOT CRACK THE COIN OUT YOURSELF!!! Submit it as is in the holder and let PCGS or NGC crack the coin for you if they determine it is an MS coin.
