Don't wait for him. File the ebay/paypal complaint ASAP. Also respond back to him ASAP that he is quite aware of the fact that strike discussion is meaningless in the face of a cleaned coin, and that the first reply was frankly insulting and makes him suspect. Don't let these guys breath.

I am going to wait a couple hours to see his response. I think a "Restocking fee" of 10% is ridiculous! That is 10% of $799. If he does a full refund, I believe there is no fees incurred from Ebay and Paypal.

Never, never buy this costly a coin without,

Never, never buy this costly a coin without seeing it in person and after having built up trust in the dealer who owns it, plus perfecting your own skills in grading.
Never ever worry about "this one slipped away" either. There is virtually no coin that cannot be found at a later date and often for less $$$.
Rare coin such as Morgans are really not rare at all and all can be had at anytime sooner or later. For instance the holy grail of Lincoln's Cents the 09-S VDB is not rare at all. Go to any show anywhere and there will be a dozen or more available in mint state and 2 dozen in circ. grades. Then try and find a 1926-S even in MS-64 Red and see what you come up with? Then look at the price guilds for one in MS-65 Red and you will then know what a rare coin really is.
These, and at least one million more fine points are the foundations of our hobby or in more scientific jargon - "it may be complex but ain't it fun"!

    If there is any doubt that you can get you money back, read this;

    http://www.cointalk.com/forum/t35026/

It took a while and a few more nasty notes from WmsJewelers and some time, I wound up with a full refund less only my return postage.

I noticed he didn,t mention anything about a restocking fee in his ad. He should be notified about that.

You can if you want but I do not pay those type prices for anything.

So you can't trust Heritage? My best coins all came from the net.

You can if you want but I just do not pay those type prices for anything.
I did not say who you can and who you cannot trust - I'm just giving my advice. It's no big deal - you can trust anybody you want to. I even know 2 of the catalogers from there if you ever need a contact.
Look, I own and run a coin show each month. I am fortunate that I have all these coins that will, sooner or later just come to me. But it is also through a lot of work and study that "I am where I am".
Don't be so sensitive,,, I was just giving this man "my best advice".
What I was attempting to covey is - these coins are not rare - learn to grade - develop a relationship with someone you can trust.
And yes, I would never buy a coin over $300 from anyone I did not know and if near shows and shops you do not need to buy a coin off the Internet - the high graded Morgans are not rare at all so, wheres the fire - you will find them.

Thanks a lot for pointing out something I should have realized before I even bought this coin. There will be another one, perhaps even better, and perhaps at a lesser cost. These coins are not nearly as "rare" as ebay prices would indicate. And while it is possible to get the bargain of the century off Ebay, it is unlikely and in the end you would be probably be better off paying fair market value at a reputable local dealer.

As far as this ridiculous "restocking fee" no, he makes no mention of it in the listing. I should not have to pay that, and I won't. I don't mind the return shipping, it's minimal in the scope of things, and I guess I deserve to suffer (somewhat) to learn my lesson.

What an amazing group you guys are!!

Thanks! (I can't say it enough)

If nothing, you know that I'm generally not sensitive, but you repeated this over and over again and It's just not right. In fact, I've have good and bad experiences with both internet buying and buying face to face. They both have their perils.

With Ebay particularly, I agree with you 100%. Unless your an expert buyer, ebay is a shark tank.

    *update*

Ok so this guy emailed me back, what a beauty he is!!

    "Dear mofrad,

you're right this coin is worth hundreds more than you bought it for you have to send it to pcgs or ngc etc to get a proper grade. this coin has not been tampered with in any way. I don't sell coins that have knowingly been cleaned. All coins have been cleaned at some time or other wayne boler there is still a 10% restocking fee."

    hm.... now what to do!

What I repeat is my opinion and I will always,

What I repeat is my opinion and I will always stand by what advice and opinion I give - for you to tell me it's just not right is your opinion worth exactly as much as mine. Whatever you think is right is your truth and what I think is mine.
There is nothing in this world that is not true or is very true that does not come with caveats and the all important exclusion of, "It depends"
This collector spent a large sum of money that I believe he immediately regretted for a coin pretty much sight unseen. I pointed out that my advice is to never spend that much money for such a sight unseen coin especially with him being new to the hobby.
How could anyone fault that logic?

Send this and RIGHT AWAY call Paypal

    Dear Sir

At this point your clearly a fraud. Hands down both experts and armatures in the coin collecting can identify this coin as severely damaged and there is no way that this coin can be slabbed by any reputable Third Party grader, especially those approved by Ebay. Furthermore you are now in violation of Ebay Policy which forbids such unsubstantiated claims, which in this case are clearly lies with an attempt to defraud. I expect a complete refund before further action is taken against you. You should also be aware that this dispute is being made public both on various coin collecting forums and on USENET. Your continued attempt to defraud me is going to backfire on you in ways you have not yet conceived of. So I advise you to play by the ebay rule book and give a full refund, or face a tenacious response by myself and others in both the ebay community and the large collecting community at large. I will not hesitate to use any weapon at my disposal to put light on your fraud.

    Kindly

    Your signature.

Then after emailing him his, post everything to

    http://groups.google.com/group/rec.collecting.coins/topics?pli=1

and send a certified copy of this letter to him by snail mail.

And then also contact the Mail Fraud hotline of the US Postal Service.
