I will disagree---and I disagree because I have facts that you are wrong. I don't believe that the guy that it happened to has a website so I can't point you to it online...but you will just have to take my word. A very well known Artist that drew Col. Sanders--KFC sent a bunch of lawyers who sat down and went over every little piece of paper work, and were ready to sue if he did not quit making prints. The ONLY way you could draw such a person is if YOU took the photo that YOU are useing to draw from. If you are useing someones elses photo, then both the guy who took the photo, and the family of the person, can come after you. I'm not making this up-- Speedy
My wife works in a bakery and customers are always asking for copyrighted characters on their cakes. She has to refuse. She can put on a character that comes with a cake kit that has paid for the right. she can put a character on a cake for use at home (for us), but not on a cake that is for sale.
Selling prints is not the same as making the prints and arm twisting with lawyers is not a determinant of law. Let them come to my house and twist MY arm...see how far it gets them. Your misunderstanding. An Individual is protected to draw and make any original work. You can't stop someone from writing or drawing or painting in the US of A, of anything an individual wants.... PERIOD and repeatedly protected by hundreds of court decisions. Your mixing up original art with commercial exploitative printing. In fact, Campbells Soup sued Andy Warhol and LOST LOST LOST. I also know this is false for a fact. I did a cartoon for a compilation book once that involved Col. Sanders....the trademarked cartoon version, not the real person by the way who isn't trademarked or copyrighted....and needed to obtain permission from KFC. Suprisingly I was granted permission, so long as the recreation did not detract from the business. Back on topic....I think....it would be neat if the YN artist could do some numsimatic art to take to coin shows, much like Daughtrey does. A nice portrait of Jefferson with the original nickel design as a backdrop, something along those lines. Guy~
