Ebay buy turns into comedy

    I bet this guy is 30 to 40 years old. Bought some scrubbed out washed/dipped lincolns and is trying to scam. I guarantee it!

    More than likely...what I don't understand is how someone has so many online sales and such bad customer service. I also love how he made sure you knew he was an almighty eBay POWER SELLER!!!!! :)

    You are reading a whole bunch more into those policies than I. I would also be willing to bet you that despite AJ's winning his dispute, eBay will do nothing to the seller because of it.

    Tell me where I am reading into what:

    eBay expects sellers to consistently provide service that results in a high level of buyer satisfaction.

    When a seller lists an item on eBay and a buyer bids on or buys it, the seller and buyer enter into a contract that both members are expected to honor. For sellers, this contract includes both formal requirements, as well as informal, "common-sense" obligations to provide good service to their buyers. If the seller doesn't meet these requirements, it leads to a bad experience for the buyer and may result in negative or neutral Feedback or low detailed seller ratings (DSRs) for the seller.

    Sellers who don't meet these requirements and obligations are not honoring their contract and are creating bad experiences for buyers. Sellers who create excessive bad buyer experiences compared to how much they sell may violate the Seller Performance policy.

    Buyers can let eBay know about their experience with a seller through item not received or item significantly not as described disputes, as well as Feedback, including DSRs.

    It is clear that Jack has the right to ask for a refund and the seller did not explicitly say no refunds, so Jack is in the right with no questions (other than switching coins but I know Jack wouldn't do that).

    Ps: As to actually doing something to the seller, I doubt it too but the policy is in place for them to do something and that is something Jack can use to his advantage when "discussing" this with the seller. ;)

    Pps: Also, when Jack sends Ebay a statement, it would help Jack to point out things that are a violation, without mentioning it's a violation. ;) (ie. - the coins were listed as Uncirculated when they weren't, they were cleaned/polished circulated coins and thus, not as described.)

    I mean that shouldn't matter if it there or not for Jack's case. Unfortunately, Jack will probably spend his time, emotions, and postage as much as the price. I think paypal/ebay will settle it OK. At least I hope so for all of us Ebay users' sake.

    I think if they do something to him or not is besides to point, as long as the money is returned.

    Jack, I don't understand why its hard to get photos up? How are they wrapped up?

    Interesting! Jack should point that out to Ebay, since the Refund Section says this:

    Return policy not specified.
    Read item description for any reference to return policy.


    I checked the Item Description and it is void of anything as to a refund policy, so the seller hid it. That easily "leads to a bad experience for the buyer" and can be disputed.

    There is a section that specifically applies to refunds (or in the Item Description) and the fact the seller hid it elsewhere's makes his No Returns Policy null-and-void.

    I didn't see this when I looked the first time and I looked up and down for the refund policy. I needed to use grep to find it.

    If I did read that, caplocks and all, I'd NEVER EVER bid on anything from this fool.

    It gives you a good idea that he's a wack job and a con artist. What does, " I FULLY DISCLOSE EVERY ITEM THAT I SELL AND EVERYTHING ABOUT IT THAT REQUIRES MENTIONING-" mean to you? To me it means he doesn't disclose what is needed, only the bare minimum of what is required, and furthermore, he's had disputes as such before.

    I completely agree, it was just that Toad seems to think that the seller is going to be somehow sanctioned by eBay for violating their (eBay's) policies. I was just trying to convince Toad that it is just not how eBay operates - not should it IMHO. Jack should get a refund because the seller misrepresented what he was selling. Because he did this once will and should be meaningless. However, if the seller repeatedly does this, then something may happen. And the exact definition of "repeatedly" is open to discussion, but as yet, he has not met eBay's definition.

    If Jim hadn't pointed it out, I wouldn't have seen it either and that is a point Jack can make, he didn't see it either, since it wasn't where it belonged. But all of that may be moot if there is a formal Refund Policy required by Ebay, which I am 99% sure there is but I can't find it at this time but I've got friends working on it as I speak and they should have the link shortly. ;)

    It's not a matter of difficulty Ruben, it is a matter of time. I have been in and out all day, and off to the movies with the wife now.

    Seller and I have resolved issue. Even after all that, I will leave him a " positive ", not a glowing 20 stars, but a polite thank you.

    I'll get pics up Tommorow or after the movie tonight.

    Return policy stated in the auction ONLY applies if items are ACCURATLY described. If misrepresented, and seller is reluctant to work a deal, I go straight to paypal now.

    Could we start a thread "Ebay sellers to Avoid", or could it put the forum at risk. Maybe "Ebay Sellers I Would Avoid', with personal stories.

    These are what arrived. I have dealt with the seller and accepted a partial refund, paypal claim cancelled.

    Starting at top left and going clockwise, it should be obvious that coin # 4 and 5 are not uncirculated and have been dipped. Coin 1-2-3 might make it, 63 red.

    My new camera is still out smarting me, so the pics could be better, but are a pretty accurate representation of the coins. Anybody who has ever searched an original roll would spot this right away. Item not as described.

    I am a powerseller also, it's no big deal.

    You have to do at least $3000 a month on the bay and maintain good feedback. You get discounts according to your " star" rating, I have 4.9+ in all but shipping, a 4.8, so I get a 15% discount on fees. It's also cool because I can call Ebay and get a human on the phone, something others cannot do.
