For 1, that's copyright infringement; for 2, it's probably a financial loser for you, at this point; and for 3, if they're making false representations with it, it's deceptive advertising, fraud...bring it to the attention of your state's attorney general. Bottom lines.
you can report that to ebay, also you can always swap the picture for something else :kewl: that in case they you directly linking your picture.
