The seller's info says he is Massachusetts but by the way he writes I would have guessed China.

This is such an obvious fake that I can't understand how anyone can be fooled. This is an example where a Red Book pays for itself many, many times over. 1864-S indeed.

Unless someone is bidding because it is a fake I don't feel sorry for someone that gets taken this easily. 5 minutes of research would show it is not real.

Won for $124. I'm surprised this auction wasn't pulled.

I reported it, but eBay just does not look into these reports I guess. Is it against eBay rules to email the buyer?

I believe it is against ebay policy to contact anyone you are not directly involved in a transaction with.

But there's a 50/50 chance someone will email the winner and tell him that the coin is counterfeit.

Oh! Yes! They look into such thing, but if you read the message as you send it, they say it takes 24 - 48 hours for their reaction. In this case, they are going to report it to another group who will take some more time. They will move, it just takes time.

The winner just wanted to fill a hole in his album. Or, it'll be up for auction in a few weeks or so.

I did notify ebay and got this "response"

We will review the listing(s) you have reported for violations of our
Replica and Counterfeit Items Policy. We often rely on members like you
to bring such violations to our attention.

In light of eBay's privacy policy, we cannot share with you any action
taken by eBay with respect to this listing. If we determine that the
listing violates this policy, we will remove the listing or suspend the
seller. Account suspensions are usually reserved for those sellers that
    repeatedly disregard policy.

If the item you reported does not appear on its face to violate this
policy, we may refer it to the intellectual property rights owner for
review. If the rights owner has a good faith belief that the item is
infringing, they may choose to send eBay a formal request to remove the
listing. For more information on eBay's cooperation with rights owners,

My guess from this response is that you reported it to the wrong place. Did you report it to the site they have set up specificly for taking reports of fake coins?

    http://contact.ebay.com/ws/eBayISAPI.dll?ContactUs&userid=&UsingSSL=0&siteid=0&partnerid=2&wftype=2022&subject=Selling%20Coins&bcrumb=Topics%20%3E%20eBay%20Policies%20%3E%20Rules%20for%20Sellers%20%3E%20Listing%20Policies%20for%20Sellers%20%3E%20Selling%20Coins%20&rcode=BN%25P10072&err=0&dstURL=&bshowgif=false&bc1=default&bc2=default&bc3=default&bc4=default&bc5=default&bc6=default&bh1=default&bh2=default&bh3=default&bh4=default&bh5=default&bh6=default&history=default&rdir=0&hc=1&hm=uu.re%60j45717

Fake coin reports sent here get much faster action than reports sent to the replica and counterfeits report page or reports made using the "report this item" link at the bottom of the auction page.

Here is my response from eBay reported to their coin reporting site

You're right. I did report it to the wrong area. However, I also sent emails to the winners of two suspect coins and each responded that they did think the coins weren't on the up and up, but that they completed the auctions anyway. I suppose they'll take the coins and dump them on someone else later.
