A scratch and dirt don't necessarily make it other than uncirculated. Were images included in the listing? If not, it was unwise to bid. If so, did you receive the coin that was imaged? Did the seller state his return policy? If not, it was unwise to bid without asking him about it first. If so, and you can meet the conditions of the policy and you don't like the coin, return it.
