Slabs only kill value?

    Jack, assuming for the sake of argument these items are the same coin, two things. First, I think it's unbelievable you even caught this guy in the first place (you deserve a medal for that). But second, if you're going to report him, as Mark suggested, you want to focus on the following eBay policy language, "other information which may have a material impact on the coin or paper money value," as, that's where you've got him. In other words, he has knowledge, it's a material fact in the coin's value, and he's not disclosing it. Period. Forget about any "puffing," affirmative misrepresentations (if any), i.e., what he "said." Get him on what he didn't say but should have said. That'd be that slabbing information, right? Good luck.

    Is this seller (dealer) an ANA member? If so he is bound by the ANA Member Dealer Code of Ethics which say, in part:

    As an ANA member dealer, I agree to comply with the following principles:

    . . .

    To refrain from making unjustified and/or false statements or misrepresentations in my relations with others . . .

    I interpret that to mean he cannot misrepresent a coin to buyers by failing to disclose known defects such as those noted on a TPG slab. Failing to disclose that a coin has been cleaned or altered when you know it has is similar to failing to disclose known defects when selling a house.

    I could buy Huricane Katrina flood cars, insurance totals elcheapo, and sell them on eBay Motors not described as damaged, and with my new AZ tags, probably make good money. SAME THING. Deception.

    All the links I have posted on this thread , santas/seated are reported already. When I get some time later tonight, I will actually do everyitem he has up for sale. Not because I am a self declared Ebay vigalante, but I am a coin collector first, and this hurts the hobby. Hurts all of us.

    I will let you all know, this is not just me, there are actual people with some power onto this crook , for a while now. I just get heads up's now and then and post them here.

    Haven't read the whole thread but get the gist. If I repeat something please forgive me.

    My point is this. If the guy gets nailed to the wall do you think he'll try to sue? (ebay - anyone he can).

    Slimeballs like this are often into the lawsuit angle as well.

    Let him try. He is slime AND in violation of Ebay's policies. He wouldn't have a leg to stand on.

    He has threatened to sue me already, I told him, excellent !!!! I have quite a story to tell when it's my turn to talk.

    He sees this thread and emails me demanding to know who is telling me this, or else !!! Or else what?

    Jack,

    You should do as I did concerning the Seller that sent me the altered coin! I did a "copy" on the entire Auction for the coin I won and "pasted" it to my email, then sent the email to myself. You should do this with all of the Auctions for coins that he has won and all of the coins he has sold or currently has up for Auction, The Auction listings on eBay may no longer be accessible on eBay with time but you will have the Auction listings in their entirety saved in your' emails! I do this so that in case I ever have to go to Court, I have a copy ready and available.

    I just hope you do too Jack. For if he does sue, you'll spend upwards of $20,000 before you ever see the inside of a courtroom, if you ever do. Suits are not something to be trivially dismissed.

    Be careful what you wish for.....We have been married 2 times to each other. Ever try divorcing an attorney? LMAO, I'll never do it again, I'd rather suffer a long slow married painful death

    I have received an email from Chris, Seated Liberty. He has had it with the coin business and is quitting for good once his current listings are ran out.

    He also has revised the auction to include tooling and cleaning........, good only about 8 more to go...

    Doug, he has admitted it is the same coin...

    Jack, I read his auction revision and feel that it was a cop-out, as opposed to a sincere effort to disclose relevant information about the coin's problems. He has my attention and, despite his claims, I don't plan to let my guard down.

    Yeah, pretty lame I agree. I just read it also.

    He has used the " Im quiting coins forever" thing everytime he switches Ebay Id's, only to show up again with a new ID.

    Does go to show, that these coin boards can have SOME affect, even small.

    That is what I was going to state "he is probably quiting until he has the time to switch Buyer and Seller ID's" before I got a call from my Lawyer and had to go off-line! And no, I did not marry my Lawyer!:whistle: My wife is German and Italian and is enough trouble without being a Lawyer!:headbang::headbang:

    This has gone far enough, breaking out a coin from a slab and reselling it is not illegal, and it is not against ebay policies. In my auctions I am not guaranteeing anything about the coin, other than it is authentic. The buyer has 7 days to inspect the coin under a microscope if they choose.

    But this has gone on far enough, and I cannot stand dealing with children who nit pick at me instead of worrying about themselves.

    I am actually HAPPY to be done with this business. You've got your wish, and I've got mine. I'd rather die poor and hungry than deal with people like you who act like a 5 year old.

    Once I liquidate everything I am done, and I will be taking a LONG vacation from everything, sounds like you might need one too. You are wound up way too tight.
