Help with a problem

    Hi!

    This is the first time I have this problem. I don't know what is the following I can do.

    Last February I made an order with Muntplaats (http://www.muntplaats.com). I ordered several coins by INSURED mail. I made a bank transfer to them and waited for the parcel. In April, as I have no notice from the coins, I asked to Muntplaats about my order. They reply that they were moving to a new office and they asked to me I will wait until the end of April. After a lot of e-mails asking for my order I got an e-mail from Muntplaats saying that the parcel was returned to them and sent again. At the beginning of June I got another e-mail from Muntplaats (after several e-mail from me) in which they told me about lot of problems with parcels to Spain!. At the beginning of July I sent to Muntplaats another e-mail, and others at the end of July, and the end of August.
    At the end of August I got an e-mail from Muntplaats in which they told me they will check with the post. In October I got an e-mail in which they told me they have no news from the post office. In November another e-mail saying they will give a solution to my problem at middle November. Since then, I have no notice from Muntplaats.

    The order was made one year ago. The postage was paid as INSURED. I have no response from the dealer since the beginning of November.
    I though Muntplaats was a serious dealer but his response has been very bad.

    My question is: Have I any option to get my coins or to recover my money?

    Mr. Quintana,

    As the large majority of members on this site are from locations other than Europe, most have probably never dealt with Muntplaats! However, there could be a few members in Europe that have dealt with them and can offer you some insight into your problem. Although I reside in the U.S., I would recommend obtaining their' address and writing them a formal letter about what has happened and that you either want the coins that you ordered or a full refund of your money. You might even want to obtain their' telephone number and give them a call. If you are talking about a small sum of money spent for the coins, then it is possible you may never get the coins and will have to chalk it up as a loss. However, if the amount you paid is a fairly large sum of money, then stress to Muntplaats that you will seek restitution through the Court System if they cannot comply with your demand (either send you the coins or return your money). I would contact an Attorney that is familiar with and can file as well as argue a Law Suit in the World Court (as this is probably the Court that has Jurisdition over such matters).

    Welcome to CT.
    Wow almost sounds like a scam. Keep the paper trail and maybe further it by sending registered mail asking for the coins, refund and go to your better business bureau with COPIES of your paper trail.
    Can you call them and talk with the Manager or somebody higher?

    Looks like I'm repeating Frank so I'll stop. Let us know what happens with this and good luck.

    The correct name for the "World Court" is the "International Court of Justice", a UN agency with jurisdiction over disputes between nations, not disputes between citizens of individual nations.

    From the name I assume this dealer is a German company, so a dispute of this type needs to be dealt with in the appropriate court within the German court system. A Spanish court would have no jurisdiction to enforce a judgment against a German company, unless the company has offices in Spain and the transaction occurred there.

    BTW the World Court has no power to enforce its decisions other than voluntary compliance by national governments, which doesn't always happen.

    I admit that I don't know much about the World Court! However, my Father-In-Law is an Inventor in Germany that has taken many disputes and Law Suits to them to get resolved. Some have included disputes against the German Government as well as other Countries.

    Muntplaats is a Coin Business in the Netherlands (Nederlands in Europe)!

    Thank you very much for the responses and thank you for your welcome to the forum.
    I've been collecting coins since long time ago.
    My main interest are coins from Europe and ranged between 1800 and 1900 (more or less).
    After the appearance of the euro, I've also collecting them. My order to Muntplaats were some euro coins and some modern russian coins.
    Usually, I've ordered this kind of coins from a dealer in the USA (www.eurocollections.com) and never had any problem with them.
    Unfortunately, last February I decided to order from Muntplaats some modern coins and this is the origin of the problem.
    The amount is not great (about $150.00) but it is the scam what I don't put up with it.
    I've been scammed once by swapping coins with another collector, but in this case, it is something which can easily happen.
    But who would have thought it from a established dealer!
    Obviously, I have his address (in The Netherlands), I live in Spain and I have interchanged a lot of e-mails with the owner (I think). The only response has been to put off doing the problem (I am patient, but the order was done in February!).

    So, I don't know what can I do to either obtain my coins or a refund of my money.
