Although many think giving credit to the owner allows them to use their pictures, it does not. As for Fair Use, the way that works is that only a small portion of copyrighted work may be used. For example, with an article or a book, you may use a few sentences or a paragraph without written permission, and you may not even use that much if you stand to gain financially. With pictures, there is no Fair Use as each picture is a stand alone copyrighted work all by itself. The one exception might be if you were talking about using a picture or two from an entire book of pictures. Quite correct, and so is every word you write. And no you absolutely do not have to file a copyright - the copyright is automatic and takes effect the instant you write, or take the picture. So yes, using somebody else's picture without their written permission is indeed a violation of copyright law, as is using anything they write. As for this - This is part of the Fair Use clause and it applies as I have described above. And for the record, CT does enforce copyright law, meaning we will remove copyrighted material from posts. Assuming we know or can prove it is copyrighted.
Did you ask Samuel L. Jackson for permission to post his picture??? Anyway, Maybe I'll start a new thread about the picture thing. Let's see more oddities before it's too late........
You can't use a picture on a public website and expect people not to use it, save it, share it and do whatever they want with it. If I did wrong by posting the other persons, or the poster doesn't want it posted, I'll do my best to try to get it removed, but I really highly doubt they will mind. I think the only thing they will mind might be the constant notifications they will get because of this, without their permission. I would then tell them about the "ignore thread" feature. But yeah he posted that coin on a public website with no password protection and no guarantee for privacy. Therefore I feel like I can use other people's pictures. If I am wrong for this, owell I am sorry?
I feel the same way. I just wanted to point out what I thought to be useful information, that sidetracked this thread. My apologies to OP for that.
Heck, most of the pictures in the last cherrypickers guide were used without permission . I know that for a fact ....
Also. I could even use someone's face (like Samuel Jackson) and act like I am him. If the police find out I been tricking people into thinking I am him, they can do nothing about it. Unless I was scamming people for money. There are numerous websites like Facebook and instagram with fake celebrities profiles that have hundreds of thousands of followers. Oh yeah, there are plenty of Elvis impersonators out there making money off the fact they look like Elvis.
John wexler would be one rich man if he could sue us for using all his images haha. And we make money off those images too. The fact he doesn't charge to use the site, is a very nice.
Hahahaaa looks like rick has a collection going on with this idea. That's awesome, thats what I hoped. I think this penny wants to grow up to be a nickel
I don't think anyone has or will argue that it doesn't happen. Hell, a certain someone we all know, who will go to no end to protect his "work" or even a few words strung together, was once called out for using photos not belonging to him, but doesn't change the greater point here. It may not be the end of the world in many to most cases, but it's simply wrong to state that, particularly when claiming "in the eyes of the law", any and all photos are free for the taking. Years ago, before the internet became commonplace, a photo I had taken years prior was used for a commercial purpose without my permission. Not only that, but the individual credited himself instead of simply giving me the nod I both deserved, and that would have made using it okay with me. It may not seem like a big deal, but what if this had been my livelihood? Also, it often takes much time, planning, and expense to get better shots, not including the often high cost of quality equipment, so it's quite reasonable to state that stealing one's photo can potentially be every bit as damaging as taking physical property. That said, if (IF) the CP guide is using photos without permission, I see that as a very big problem, and have a hard time believing Whitman would stand for such a thing.
If memory serve me correctly, it was the fall of 2015 and the new cherrypickers was out . Someone brought a coin to the table and I went to the dealer next to us, to borrow the book . To make a long story short, when that book was opened, someone wasn't happy, his images were in the book . Also could of had something to do with him fighting cancer and him dropping out of being one of the authors . But like he said, what you going to do .
Just as an FYI - for those who think it's no big deal to use copyrighted material as you see fit, remember this. Doing so is against forum rules. Now the first time or two you get caught you'll probably get away with nothing happening but the material being edited out. But if you continue to break this rule, then our repeat offender policy will come into play and you will get infraction points for each offense. And those add up, get 10 points and at the least you're banned until the time period expires. Repeat the same offense enough times and you may be banned permanently. One must always remember that in life even though they can choose to do as they wish, those choices have consequences. So sure you can make the choice, but you must then live with the consequences.
Just in case someone doesn't know how to spot a copy right, here's what you look for. If it had this, I assume you cant use it for personal gain or profit on this website. I am kind of wondering how exactly someone might get in trouble for using copyrighted material for personal gain here on this website. Would be interesting to know an example if you are bored enough to tell a story!
