You missed the fact that the only thing ebay cares about is getting their fees. Unless you're a big company with lawyers threatening lawsuits ebay doesn't care. The best you can do is be knowledgeable to protect yourself and hope the next guy doesn't get screwed too badly. Occasionally, you get lucky and they will take down an auction or in rare cases suspend an account but don't hold your breath
The fact that its' non-authenticity is admitted doesn't change the fact that it's not permitted by either US law or Ebay rules. This should indicate Ebay's lack of commitment to anything but the bottom line - they willingly provide a venue for the violation of US counterfeit law. I suppose the argument can be made that the "intent" aspect of the law is not present here.
Go read eBay's terms of service, you won't find the word CARE in there anywhere. They care only to the extent somebody holds their feet to the fire. Since nobody does, they don't give a rat's furry posterior about counterfeits.
Notice that there's no motto "IN GOD WE TRUST." But everyone knew it was counterfeit, otherwise it would've sold for 5 times that.
We all know its not an authentic, genuine, real US issued coin. "'counterfeit' means you are trying to deceive someone, while 'fake' just means it's not the real thing." (fake money is used in the movies) There are untold 'coins' of all denomination and from untold countries; Even, or especially, ancients, that can be found on eBay any given day. And who cares? Not most of the sellers. Certainly not eBay. Not even the prestigious ANA! We have all tried to get it stopped. We've done our part, besides, who gets hurt. An unsuspecting collector. Of course. It will likely stay in his collection until he dies. There are many buyers who like these counterfeits/fakes. They take them to the flea markets every weekend and another unsuspecting boob gets taken. Who care, right. Do you know that every denomination, every year of every coin that the US mint ever made is being sold by the Chinese? Even other countries are getting in on the action. But who cares. I know one guy who cared. The guy who bought an uncirculated set of Lincolns, in a nice new album, with the only 'authentic' coin being an AU 1909-S VDB. Great, right? He got an AU '09-S VDB. Every other Lincoln was counterfeit! Guess how much money he lost? And, I was the one he got mad at for telling him what he had done. Who cares? We all should. Everyone needs to band together and fight this!

I used to report stuff like this a few years ago but gave up and quit wasting my time. Sometimes they'd remove it but a day or two later it would be right back up again. They no longer employ anyone knowledgeable in coins and they have no idea what your talking about.
It's interesting how only certain fakes spark such outrage, and "violation of US counterfeit law" is only a negative in certain instances.
In the listing, "Our store are copy coins, but there is no "copy", "replica" or other similar words stamped on the surface of the coin. They are high quality imitation antique COINS. The appearance and size is very close to the real COINS."
Well, it IS a fantasy coin right? Theres NO motto on the reverse, so, anybody who's anybody should be able to tell the difference between this, and the real McCoy from 5 feet away? Right? Or,have i been brainwashed into thinking this way? Plus, there is no intent to decieve here, so this is just a fantasy coin and the guy peddling it isnt actually passing it off as righteous. This , to me, is no different than a 1895cc seated half for example, except there is an angry mob with pitchforks outside the sellers house ready to lynch him
Since the Secret Service is the defender of the currency, let EBAY know in no uncertain terms, that is your next stop. It may take some bantering, but they backed down for me on one.
If you will go to twitter and click on @AskeBay and @eBay you can complain to your hearts content and they will answer you in a reasonable length of time. Of course it will be the standard "sorry to hear you're having trouble" etc., but at least the whole twitter community will see it. They don't like so much negativity at one time. So, everyone should blitz them. BTW, when you arrive at @AskeBay site click on 'tweets & replies.' That will give you the up to the minute conversation. And it will require us to continue to follow up on a weekly/monthly basis.
