Depends on how the scratches arrived on the coin. Bag marks and digs are common on uncirculated coins. Uncirculated does not mean perfect. Just that the coin has no rubs or been lying around in your pocket. This coin in your link has been damaged. Therefore, it would be bodybagged as dthigpen pointed out.
Except it can't be all grades - just MS70 and PR70 with a couple lower grades thrown in for credibility. At least this coin was graded MS63. That's probably the lowest grade they have.
