I hate to say it but to be it looks to have been cleaned [notice the parallel lines on the obverse and may not be gradeable], also it has some greenish blue to it on ER of AMERICA which may be PVC damage?
It seems the streaks go along the entire obverse. But I cannot see any on the reverse. I dont know if its been cleaned then. But some of the better grading companys will grade it with the caveat being ''cleaned''. At least ms-63. Real nice tho.
The scratch on the reverse will keep it out of a slab. Pics are too small to say for sure but it looks like it has MS details.

I agree with GD about the scratch keeping it out of a slab and I think it looks AU to me. I'm seeing some wear on the high points of the reverse.

spock1k, my personal recommendation if you're looking for a high grade coin like that on the internet is to only buy one that's certified.
My first thought upon seeing the coin was that it was counterfeit. It looks too cartoonish -- but it could be just the photo/scan... The above notwithstanding, I would grade the coin AU details, cleaned/scratched, net XF. Regardless, unless I could get a price commensurate with the above grade and a good return policy, this is an auction/sale I would run away from -- there are much better examples to be had.
