Advice needed: coin never recieved/ebay

    I recently won a auction for a coin on ebay. The coin never showed up , this was over a month ago. The seller is very nice and responds to all my e-mail, also has 100% feedback. The coin was under twenty bucks so I did not request insurance. So the seller has contacted USPS and they are sending some kind of form to fill out. The seller says this has never happened so he has no idea what will come of it.

    Has this ever happened to anyone? What are the chances USPS will resolve this? I don't think the seller is obligated to give me a refund, is he? What do you folks think?

    My opinion...You took the risk of shipping loss by not getting insurance. Let us know if UPS covers it....

    I'm not sure if it's insured up to a certain amount. Best to check with USPS, but it doesn't necessarily sound fishy to me. I do believe that the seller is the one who needs to fill out the form though, as it is his responsibility in the eyes of USPS.

    I always take insurance - gives me the warm fuzzy feeling. I do not think the USPS will re-imburse you if you did not have insurance. At least the seller is being nice.

    About a year ago I sent in a bill payment by mail about 15 days before it was due as always. About 3 weeks later I got a late bill with a late charge. I called and explained I had sent the payment.They said they never recieved it so I sent another payment and Seven months later the First check I sent arrived and was posted to my account. So don't be surprised if your coin shows up at your door a year from now. :confused:

    Yes, but it was insured - not by my choice. I really suspect that he never sent it because I won it so cheap, but I got a full refund.

    Without insurance, NIL.

    I once looked into this. eBay rules (customs?) are it is the buyer's loss unless the seller does not offer insurance.

    Sorry, but the insurance does nothing for YOU. It protects the seller. This has been discussed in several other threads.

    Has the seller offered any proof that he actually shipped the coin (ie USPS receipt, delivery confirmation no., etc.)?

    I hope you are lucky... I once had an item reach me thru USPS a ful 42 days after the poskmarked date...

    If the seller did not use delivery confirmation than it will be him that is out since there is no proof that he sent it--at least if you paid with paypal. Glad to hear he's being helpful...let us know how it turns out.

    He did give me a tracking # . This is what is says when you enter it:


    The U.S. Postal Service was electronically notified by the shipper on ******* to expect your package for mailing. This does not indicate receipt by the USPS or the actual mailing date. Delivery status information will be provided if / when available. No further information is available for this item.

    That is SOP for a tracking number printed from PayPal. Not really too sure what good it does (re: the post office), but something is better than nothing.

    FYI: The post office never acknowledges receiving these. They only scan at delivery.

    If you paid though paypal dispute charge because he needs to show proof of delivery or he is out of luck.

    that has happened to me. i have found usps to be pitiful. the guy refunded all of my $$$. that was the end of that. i told him if i ever did receive it, i would reimburse him. i never did receive it. =(
    it was a good deal too. =/

    I am sure you are wrong if the seller says that he is not responsible without insurance. After that, I will give you odds that he will recover nothing from PayPal. Now, if he used a CC at PayPal, he might have a shot. Actually, some CC's actually have insurance for this type of problem.

    Does't Paypal over buyer protection on all ebay purchases up to $2000?

    The first thing we need to know is how did you pay for the item? If it was through PayPal, then you need to go to PayPal and file a dispute (that you never received the item). They will ask the seller for tracking info (delivery conf., ins., etc.) and if he cannot provide it, PayPal will attempt to take the money from the seller's account. Sellers often don't do what it takes to protect themselves, and some even get huffy once they realize this (thinking it's your problem when it isn't, or that PayPal is cheating them). As was said, the bottom line is that insurance protects the seller, not the buyer. It is the seller, insuring the safe delivery of the item to you, not the other way around.

    Now, if PayPal cannot recover funds for you, the only real option is to sue the seller in court (which isn't worth the time and money for $20), but I can tell you from experieince that even with higher amounts, you can win a judgment against someone but that doesn't mean you'll ever see the money.

    Not all hope is lost...

    Yes, the USPS is notorious for losing stuff. But sometimes it actually shows up after awhile.

    I had a '95 silver set 'lost' in the mail. Contacted seller at 30 days who then sent me a refund. The silver set arrived in the mail two days AFTER the refund check. (yes, I sent him his $ back)

    I had some notes arrive 3 months after the seller sent them, so yes... sometimes things do show up, eventually.

    Not much consolation but that is just one of the reasons I never use ebay. Consider yourself lucky it wasn't a large amount of money.
