I have a question on splitting hairs.... Isn't a 'grab bag' of coins... (you know the ones that shout: gold found!)... anyway, aren't these auctions technically qalified as a lottery? Hence, against ebay policy?
The reason that "lottery" auctions are not permitted is that lottery/gambling is not legal in every state and because the auctions cross state lines, it can't be monitored. "Grab bag" auctions are still taking a chance but you're not buying a raffle ticket. It's a fine line, I know, but I can understand the difference. Everyone who wins a "grab bag" auction will receive coins. All but one person who wins on a raffle auction will receive worthless chances. And who knows if the winner of the raffle is even drawn. There is no way to monitor whether there is actually a drawing and if the seller has a friend of his buy a "chance" then his friend could conveniently win. At $1 per chance and he sells 100 chances, he made $100 for selling nothing. Aren't the scammers fun?
Those grab bag auctions are de facto gambling (lotteries) and probably fraudulent lotteries at that (does anyone verify that the "good" coins actually get to someone??) I'm tempted to bring these to the attention of our state's attorney general. He hates gambling.
I have never bought one of these grab bags because I want to know what I am getting. They say you MAY get a special coin or you MAY get a handful of late date pennies. I don't really see it as a lottery or real gambling, because you are receiving something for your money. In a lottery or gambling you are buying a CHANCE at winning something. I don't think it is any different than a gumball machine. You put your quarter in hoping for a blue gumball, but instead you get a red one. You still got a gumball.
heck all they need is guys going around automatically dumping fake auctions.And then if there is anything there not sure about they could pass that allow for evaluation,but the obvious fakes could be dumped out right away without all this hassle and time. heck by 3 days i could have done a bank transfer
Update on a dead beat seller,,,, I still have not heard from this seller, I have sent 4 emails and attempted to call him once, I got an answering machine with an unitelligable greeting , I left a message. Now for the interesting part, I also heard back from ebay, a person named Hakeem emailed me the response,, in a nut shell,, no response to my direct questions, but nice warnings for me concerning what will happen or can happen if I fail to pay this guy,, now I dont know how this works , I send an email to (paying for your item safely) which should elicit some form of concern for the buyer and his concerns of being defrauded by an ebay seller, but NO I get warned of being a non paying bidder (whats wrong with this picture?) any ways the drama continues,, I looked under there catagory for non performing sellers, they will not react unless I send them an email copy of the sellers refusal to accept payment, LOL . so wednesday I go to dispute resolution. I wont buy another coin from any seller from NJ.

At best, it is gambling, if the seller gives out the few "expensive" coins in the grab bag. At worst (and is probably most common) it is fraud, because the seller gives everyone crap, and does not give the good coins. Gumballs are a bad analogy. At least you get what you paid for with a gumball. There's no $100 gumball mixed in with the 25 cent gumballs.
Actually, I hate NJ. I'm stuck here because my kids started school before I could move and God has a sense of humor. I've already told my kids that the day they graduate H.S., I'm outta here and they can come with me or not - their choice.
It's clear to me that who ever these few uneducated people on the CCW group are do not understand my specialty of California fractional gold and tokens. It's sad that these "fakes" can hide behind a curtain and have legitimate listings pulled for no reason. I have had a listing removed every one to two days for two weeks. Of course talking to eBay trust and safety, more fakes, provides nothing but time wasted. I am convinced that there is a very vindictive person that has the power to influence eBay to have my listings pulled. This person is a weasel at best and does not belong in the Numismatic community. Since the first one was pulled over two weeks ago, I have received it back from NGC via their Express service and mailing. I paid over $100 to have a $50 coin certified to prove a point. I supplied the information to what T&S states was an appeals process but yet the listings continue to be pulled. I have been dealing mostly in Cal fractional gold and tokens for over 45 years, have all 5 star ratings, been on eBay since 2000 and a Life member of the ANA and MSNS for over 35 years. I have emails and voice messages from Heritage contacting me when they don't know what they have. I do NOT mean to brag but simply provide who I am and my credentials. I have one of the largest inventories of over 700 pieces of Cal fractional and tokens at any given time and have handled thousands. Over 50% of the items in the California fractional category in eBay at anytime are brass tokens being sold for the real deal. Yet I have invested in and maintain a website which is eBay approved to be linked off my listings educating the interested people about the differences of Cal Gold. Yet here I have some moron hiding behind this curtain ruining my business and reputation because they "think" one of my items are a replica or restrike. That is why I am postings this on this board. Hoping to reach this person and hold an intelligent conversation with them on just what kind of damage they can do when guessing or not knowing what they are talking about.
