Reported as "trademark/copyright, counterfeit item", for all the good it will do. Just noticed yesterday that a guy who was selling tons of fake early commemorative halves, then stopped after he got a couple of negs for it and took his FB private, is back in business. It looks like he got a couple of the negs removed. Starting to wonder if I should just give up and become another eBay Alibaba reseller -- it seems to be what their new policies are encouraging.
The overall look of the coin is off, especially the date. Also look at how close the B in liberty is to the torch compared to real ones.

Another reason not to buy bullion off eBay. Those purchases should be between you and your dealer. Or transacted during the half dozen or so shows within a short drive every year. Nobody needs to know your name, your address, and what your packin, ugh stackin. Good eye. Clearly fake

How he gets away with it he states these are souvenir coins, genuine handmade. Nowhere in his description is he stating the coins are genuine officially mint struck legal tender coins.
It doesn't matter what he states at least for the U.S. coins they must clearly be marked copy which they're not. The guy is selling counterfeit coins his attempt at wording his way out of it doesn't fly when these coins get bought and then resold to unsuspecting buyers as genuine.
Yep, it's against eBay policy, which says "no counterfeit coins". Previously it said "no copy coins unless they're stamped COPY in conformance with the Hobby Protection Act"; these would have run afoul of that criterion, too. Of course, eBay's enforcement of these rules has been scaled back drastically. He'll probably be able to sell quite a lot of these before they catch up to him.
I should have added to my previous post that his wording did not trip any red flags at eBay. I have tried to accurately describe items and in doing so tripped their bot which prevented me from listing the item. Nothing I ever had was illegal to sell on eBay it was just they in their finite lack of wisdom decided they did not that type of memorabilia on their web site.
