Was thinking it could go 35-40 but was hard to tell from the pics I couldn't get a good feel for the fine detail from them

Without better photographs, it is hard to grade it. Using the Grading Guide for Early American Copper Coins http://www.eacs.org/GradingGuide/GradingGuide.html and just looking at the hair over the ear would imply an EAC VF-30, but looking at the stars and the dentils alone would indicate a F-12 grade (details only at this point.). The reverse photo (on the eBay link) was unusable (insufficient resolution) for grading purposes.
I wouldn't give the coin a net grade at this point because the photos were lacking in detail. If you want to see what a truly good coin photograph should look like, look at any of the Goldberg http://www.goldbergcoins.com images. If you can post better pictures, I'd be happy to give it another try.

thanks for the replies. Pics of reverse were not good so I understand grading problems.
