When I sued a company in the past in small claims court I was reimbursed for the mileage to drive 3+ hrs round trip. No hotels or meals were needed, but I'm pretty sure I'd have been compensated for them also had there been a need for them. Just my thoughts on that.

I +1 that. It definitely is the same coin.

I'm guessing with perhaps a bit of good lighting while taking the photo, maybe even a bit of photo editing, he was able to make the picture for the listing look much more desirable than the product actually was.

I guess anyone has the right to take anyone to small claims court, but he technically sold you the coin in the picture. He was definitely deceitful considering mint luster is such a paramount part of a coins grade.

You also have the right to leave negative feedback if it is justified. I doubt he's going to spend the money on taking you to court, though.

The coin actually looks a LOT better in your pictures. I'd call it AU50, it still has some nice red. Does it cartwheel?

Personally, assuming is still has mint luster. I'd keep it for what you paid. CDN for an AU 09S is $230. I would have left neutral feedback and commented about the inaccuracy of his pictures.

This is right; the seller, who frankly looks amateurish with a stupid set-up for his pictures, the stand looks like a toilet, needs to come up to speed with his photography. It looks like this coins is way over the low end material he usually sells. Personally I believe the OP needs to revise his negative, it will probably be pulled anyway by ebay as the seller is a high volume person. Try to work things out with the other person first before going on to a public forum to lambaste him.

The coin is exactly the coin in my auction. I posted VF+ details and nowhere in my auction do I mention COLOR, that's all from her head! Except the mint luster, I did post that and although she refuses to take proper photo without that temporary plastic holder I scotch taped on 2 sides so the coin stays in place.
She received at least the XF coin, more like AU as others keep pointing out to her while my description clearly says VF+ details.

The "threat" (taken out of context by her, all are dated) she's talking about is an e-mail that was supposed to be directed at the - original bidder not her - who watched the coin from the previous week when no one bid on it. He then asked me to take more photos because to him, "the coin looks better than VF it looks XF-AU" were his words prior to my relisting this coin. I then listed it and he made the bid the first day even though it was a 7 day auction. Too bad I didn't do BUY it NOW!
What she fails to mention is that ALL my auctions, for over 10 years on Ebay, say NO RETURNS! She also failed to mention that she SNIPED it the very last second of the auction and forgot to take the time to read it or ask questions. Did she mention that she first wrote a negative feedback with BS all over it, before she opened a case? She's a vendor here of the same items. You'd think she'd know better.
Lastly, she got an XF more like AU coin but she wants a "not as described" refund? Over 10 years of PERFECT feedbacks from buyers because I always describe my coins as slightly lower grade so that when a buyer receives the coin they are pleasantly surprised. Many of the feedbacks actually say "the coin is better than I expected" go read a few.
You don't get feedback like that by cheating people. Like I told her in my 2 responses "I don't cheat and I don't steal". Hard to beleive in this day and age, but that's the truth! All anyone needs to do is read ALL my feedback from BUYERS and you will know she's full of you know what!

Sadly, in her efforts to sabotage me, she has most likely sabotaged herself. We will see. I made Ebay aware of these postings thanks to that other coin dealer that saw this and also grades the coin at AU!

Whether you feel justified in your sale, or slighted by the buyer, threats of court over a matter so small is overkill and just plain unnecessary.

Here's what to do next time: "Dear eBay buyer, I'm sorry you were unhappy. Please return the coin for a full refund. It's such a nice coin, I know that someone else would be more than happy to have it."
Problem solved. No stress. No threats. No negative. No hit on your business. No problem. Returns are a headache, but they're certainly more pleasant than what you all are going through now, wouldn't you say?

It's good you came here to defend yourself. As an ebay seller myself, I understand your frustration. Did she leave negative feedback before contacting you?

Nonetheless, it appears to actually be a very nice AU coin sold at a very fair price. On another note, you seriously need to correct your issue with photographs or you're likely to have more problems in the future. The coin definitely appears to be full red and, working against you, it also appears to have been cleaned in your original pictures. You could have gotten even better money if you had posted clear and accurate pictures. You also need to crop the pictures down! 95% of the area in your pictures is background, that's just plain dumb and very frustrating for buyers.

Good luck in resolving this issue. If I was in your shoes, I'd take the return, take better and more accurate pictures and relist the coin. It's a key date to the series and it will certainly sell....and probably for a higher price.

Yes I think it's the same coin as well but the pic also looks juiced so he's a bad seller and needs to stop that crap.

Yes, she did post a nasty negative before opening a case! That is why I have taken the stance I'm taking. I refuse to let someone bully me into returning money for bogus reasons. Read my feedback from buyers.
As far as the pictures, I try to crop it so is shows bigger but then I get a notice saying my photo doesn't meet the pixel criterea. It's still a better coin than I described so I just don't get what her problem is. What do you use to take your photos?

You need to get in closer, you're not meeting the size requirement because after you crop you've cut away too many pixels.

I use an old Canon SD700IS I bought used for $50, great little camera with a nice macro feature and a small desk lamp. The whole setup cost me $80! When I'm done, I use PaintShop Pro 7 (about $10 on ebay) to crop.

There's still a potential way to fix this with the buyer, sitgolfer. Negative fb can be undone by the buyer. If you want to ask her that, start by accepting the return and paying for her return shipping. Then apologize for the court threats, and see if she'll agree! Like some members here are saying, you'll probably get more money for it the second time around, especially with more accurate/closer photos. Why keep sinking when you might still be able to right the ship?

Well, I figured this thread would get too personal, and it has. I hope the 2 can take it on their own now to settle it through ebay as we are just rehashing.
